Proposal to expand compulsory social insurance for workers on digital platforms
The Government proposes a mechanism to expand the subjects participating in compulsory social insurance (BHXH) for workers on digital platforms.
On October 21, continuing the 2nd Session, the National Assembly listened to Member of the Party Central Committee, Minister of Home Affairs Nguyen Tien Hai present the submission of the draft Law amending and supplementing a number of articles of the Law on Social Insurance.
Regarding amendments and improvements to social insurance regimes and policies, the draft Law only amends and supplements a number of regulations on regimes and policies to ensure consistency in the provisions of the Law on Social Insurance and create a legal basis for agencies in the process of implementation. Specifically, amend the regulations in point a, clause 4 and point a, clause 7 of Article 2 in the direction that people who are receiving monthly social pension benefits are not subject to compulsory and voluntary social insurance participation.
To ensure a roadmap to expand the coverage of social insurance policies appropriately and feasibly for groups of people working without labor relations, people working on digital platforms, in the draft Law supplementing and amending regulations in Clause 6, Article 2 of the 2024 Social Insurance Law in the direction of:
The National Assembly Standing Committee decides on the participation in compulsory social insurance for people working without labor relations, and people working on digital platforms based on the Government's proposal.
However, to ensure a roadmap to expand the coverage of social insurance policies for this group of subjects, the draft Law supplements and amends the provisions in Clause 6, Article 2 of the 2024 Law on Social Insurance in the following direction:
The National Assembly Standing Committee decides on the participation in compulsory social insurance for people working without labor relations, people working on digital platforms who have jobs and stable and regular incomes based on the Government's proposal in accordance with the socio-economic development conditions of each period.

Currently, the Government Party Committee is studying and developing a new Resolution on salary and social insurance policies to submit to competent authorities for consideration and decision; this content will be specifically institutionalized by the Government directing the drafting agency and research agencies after the Party Central Committee approves the new Resolution.
The draft law also amends the provisions of Clause 5, Article 3 on the concept of supplementary pension insurance in the direction of expanding to allow individuals to directly participate.
Appraising the draft law, Member of the Party Central Committee, Chairman of the National Assembly's Committee for Culture and Social Affairs Nguyen Dac Vinh said that the Committee basically agreed in principle with the Government's proposal and explanation to gradually expand the scope of participation, ensure labor rights, social security rights, and social welfare.
However, the regulation that the group of subjects "people working without labor relations, people working on digital platforms" under the scope of compulsory social insurance participation is very broad, not ensuring feasibility, and needs to be carefully and multi-dimensionally considered and assessed for impact.
Therefore, the thẩm tra agency also proposed that the Government continue to consider and fully implement Conclusion No. 276 of the National Assembly Standing Committee, study and supplement in the draft Law to clearly stipulate the subjects and specific time of implementation.
In case it is not possible to clearly stipulate the subjects and time of implementation, and the consensus of the expected subjects is not reached, they will have to participate in compulsory social insurance, it is proposed that the Government amend this content when comprehensively amending the Law on Social Insurance because current regulations have covered the cases proposed by the Government.
