Trụ sở Tổng Liên đoàn Lao động Việt Nam.
Headquarters of the Vietnam General Confederation of Labor.

1. Position of the Vietnam Trade Union

The position of the Trade Union is the position of the Trade Union in the socio-political system, and the relationship of the Trade Union with those organizations.

- The Vietnam Trade Union is a large socio-political organization of the working class, intellectuals and voluntary workers established with the aim of gathering and uniting forces, building a stronger Vietnamese working class in all aspects; representing and protecting the legitimate and lawful rights and interests of workers, striving to build an independent, unified and socialist Vietnam.

- The Vietnam Trade Union is a member of the political system and a member of the Vietnam Fatherland Front, a center for gathering, uniting, educating, training, and building a contingent of workers and laborers.

The position of the Vietnam Trade Union is recognized by the Constitution and Law of the Socialist Republic of Vietnam and all workers, civil servants, and laborers.

* Trade unions have relationships with other organizations in the political and social system as follows:

a) Relationship between the Vietnam Trade Union and the Communist Party of Vietnam

The Vietnam Trade Union is a cord connecting the Party with the working class, with all workers.

The relationship between the Trade Union and the Communist Party in the early stages of transition to socialism in our country shows: The Party's leadership role over the Trade Union, on the other hand, shows the Trade Union's responsibility in implementing the Party's guidelines and policies, and participating in Party building.

+ Trade union activities cannot be without the leadership of the Party because the Party is the most pioneering and active part of the working class. The Party's leadership over the Trade Union was formed in the revolutionary struggle history of the working class and the Vietnam Trade Union. Under the leadership of the Party, the Vietnam Trade Union actively participated in the national democratic revolution, the resistance war against the US for national salvation and in the socialist revolution in Vietnam.

+ The Party leads the Trade Union with the guidelines and policies of the Congress's Resolution, and the Party Committee's Resolution. The Vietnam Trade Union, with its functions, implements the guidelines and policies of the Party's Resolution into its organization's work program.

+ The Party leads the Trade Union through promoting the role of each party member in the Trade Union organization at all levels.

+ The Party respects the organizational independence of the Trade Union organization, does not interfere, does not assign Party cadres to do Trade Union work. The Party only introduces party members who are outstanding union members for the Trade Union to consider and trust to elect to the Trade Union leadership at all levels through the Congress.

+ The organizational independence of the Trade Union means: The Trade Union builds an organization and operates in accordance with the charter of the Vietnam Trade Union organization on the basis of the Resolution of the Trade Union Congresses at all levels. It is necessary to avoid misunderstanding that the Party's leadership over the Trade Union is the direct interference of the Party in the Trade Union's work. The Party does not assign Party cadres to do Trade Union work, but the Party only introduces good Party members for the Trade Union Congress to select and elect to leadership positions of the Trade Union. At the same time, the organizational independence of the Trade Union must not be consistent with the "isolation", "neutrality", "opposition", "separation" of the Trade Union from the Party, leading to alienation from the Party's leadership over the Trade Union; If there is confusion, it will lead to deviations in operating goals and no longer the true nature of a revolutionary Trade Union.

+ The Party inspects the Trade Union for implementing the Party's guidelines and policies.

b) Responsibilities of the Vietnam Trade Union to the Party

+ Trade unions are the ones who propagate and disseminate the guidelines, policies, regimes and Resolutions of the Party, and laws of the State to the masses of workers, civil servants and laborers, and at the same time mobilize and organize for workers, civil servants and laborers to seriously implement them.

+ The Trade Union regularly organizes for the masses to participate in contributing opinions to build the Party with a spirit of frankness, sincerity, honesty and constructiveness.

+ The Trade Union regularly fosters and trains workers, civil servants and laborers, thereby selecting and introducing outstanding union members to the Party for consideration and admission, in order to supplement and strengthen the worker component in the Party.

+ The Trade Union grasps the thoughts, aspirations, and grievances of the masses of workers, civil servants, and laborers reflected to the Party, so that the Party can study and propose correct guidelines and policies, meeting the legitimate requirements and aspirations of the masses of workers, civil servants, and laborers.

c) Relationship between the Vietnam Trade Union and the State

+ Under socialism, the relationship between the Vietnam Trade Union and the State is an equal, cooperative, respectful, and closely coordinated relationship in all aspects of activities to achieve the common goal of: "Rich people, strong country, fair, democratic and civilized society".

+ The State always creates material conditions for the Trade Union organization, and promulgates legal documents to create a legal basis for Trade Union activities. There is no opposition between Trade Union and State.

+ The Vietnam Trade Union always effectively cooperates with the State, contributing to building a constantly growing state government. The Trade Union is the one that provides, fosters, and trains outstanding cadres for the Party and the State.

2. Role of the Vietnam Trade Union

Saying the role of an organization is to talk about the impact of that organization on the development process of history and revolution, reflected in the economic, political, social and ideological fields where that organization exists and develops.

a) Before gaining power

The Trade Union plays the role of a class struggle school, the Trade Union mobilizes and organizes workers and laborers to fight against the bourgeoisie, protect the rights and interests of workers and laborers. The Trade Union's struggle is increasingly developing, from economic struggle to political struggle with the aim of overthrowing the ruling class, eliminating the regime of exploitation of people, and seizing power into the hands of the working class.

Today, in the context of a multi-sector commodity economy with a socialist orientation, the role of the Vietnam Trade Union is increasingly affirmed.

The Constitution of the Socialist Republic of Vietnam (1992), Chapter I. Article 10 clearly states: "Trade unions are socio-political organizations of the working class and of workers. Together with state agencies, economic organizations, and social organizations, they care for and protect the rights of cadres, workers, civil servants and other workers, participate in state and social management, participate in inspecting and supervising the activities of state agencies, economic organizations, and educating workers, civil servants and other workers to build and protect the Fatherland".

The Trade Union Law adopted by the National Assembly of the Socialist Republic of Vietnam (at the 7th session of the VIII term on June 30, 1990) affirmed: "Trade Unions are a large socio-political organization of the working class and Vietnamese workers voluntarily established under the leadership of the Communist Party of Vietnam, a member of the political system of Vietnamese society, and a socialist school of workers".

The role of the Vietnam Trade Union today is increasingly expanded in the cause of industrialization and modernization of the country.

The expansion of the role of the Trade Union is consistent with the inevitability, objectivity, and law of movement and development of the Trade Union organization, it is consistent with the general law of the process of building socialism.

In fact, in the historical journey of the country in recent years, the Vietnam Trade Union has matured rapidly, clearly showing its role in society, the Trade Union has attracted, mobilized education, and organized workers, civil servants and laborers to actively participate in the revolutionary cause. In the fields of social life (economic, political, social, cultural and ideological), the Trade Union has shown its active participation and strong impact through the organizational system from central to local, sectoral, and grassroots levels, through the force of union members, workers, civil servants and laborers has achieved great achievements, making worthy contributions to the revolutionary cause of the Party.

The role of the Vietnam Trade Union is shown in the following areas:

* In politics

Trade unions play a great role in contributing to building and improving the effectiveness of the socialist socio-political system. Strengthening the close relationship between the Party and the people, ensuring and promoting the right to mastery of the working people, gradually perfecting the socialist democracy, ensuring law enforcement and making the State truly a State of the people, by the people and for the people. To ensure political stability.

* In the field of economy

Trade unions participate in building and perfecting economic management mechanisms to eliminate bureaucracy and subsidies, consolidate the principle of centralism on the basis of expanding democracy. Contributing to consolidating economic, cultural and scientific and technical achievements that have been achieved in the years of implementing the Party's renovation policy. Continuing to promote and improve the operational efficiency of economic sectors, in which the State economy plays a leading role, linking and supporting other economic sectors to develop in favor of national economy and people's livelihoods. Promoting industrialization - modernization of the country, gradually bringing the knowledge economy into Vietnam, contributing to rapid integration with the region and the world. Especially, in the context of a socialist-oriented market economy, promoting the operation of economic sectors still ensures that the state economy holds a key position, playing a leading role.

* In the field of culture - ideology

In the economy, many trade union components promote their role in educating workers, civil servants and laborers to improve class stance, taking Marxism-Leninism and Ho Chi Minh's ideology as ideological foundations, guiding principles for all activities, promoting noble values, national cultural traditions and absorbing advanced achievements of human civilization, contributing to building an advanced culture imbued with Vietnamese national identity.

* In the field of society

Trade unions play a role in participating in building a strong working class in both quantity and quality, constantly improving the level of political awareness, organizational discipline, cultural level, science and technology, having political vision, truly being the core force of the worker-peasant-intellectual alliance bloc, building the foundation of the great national unity bloc, being a solid foundation to ensure the leadership role of the Party and strengthen the strength of the State.

3. Functions and tasks of the Vietnam Trade Union

The role and function of the Trade Union are closely related to each other. From the nature, position, and role, the Trade Union's function will be determined, and when the function is well performed, the Trade Union's role will be increasingly consolidated and enhanced.

The function of the Trade Union is objective, it exists regardless of the will and aspirations of each union member, it is determined by the nature, position and role of the Trade Union organization. No one can arbitrarily attach to the Trade Union functions that are not consistent with its nature.

However, the function of the Trade Union should not be rigidly fixed. Along with the development of society, the function of the Trade Union also develops, in each different historical and social condition, the Trade Union performs different functions and it is always supplemented with new content and new meaning. At the same time, the development of functions does not mean denying or abandoning the existing functions of the Trade Union. Therefore, it is necessary to understand correctly to avoid stagnation and conservatism, and at the same time avoid falling into hasty thoughts, groundlessly denying the functions of the Trade Union.

The functions of the Trade Union are closely linked to the aspects of social life: Production - business, management, economy, politics, ideology, culture - society, material and spiritual life of workers.

The function of the Trade Union in socialism is qualitatively different from the function of the Trade Union in capitalism, there is a difference that is determined by the change in the position and role of the working class and the Trade Union organization in society.

The Vietnam Trade Union has the mass nature and class nature of the working class and has 3 functions:

- The first function is to represent and protect the legitimate and lawful rights and interests of employees.

One of the functions of the Vietnam Trade Union today is to protect the legitimate and lawful interests of workers, civil servants and laborers.

The Vietnam Trade Union must perform the function of protecting the rights and interests of workers because the management level and experience of all levels of government are still weak, the State apparatus is still bureaucratic and administrative, leading to some people and some parts being indifferent to the rights of workers, civil servants and laborers, the situation of embezzlement, wastefulness, collusion, bribery, corruption, violations of the interests and lives of laborers still exist and cannot be completely eliminated at once. Therefore, the Trade Union must be the one to protect the interests of workers, civil servants and laborers against bureaucracy, against negative manifestations. That is special protection, completely different from protection in capitalism.

The Vietnam Trade Union performs the function of protecting the rights and interests of workers not by fighting against the State to weaken the State, not by class confrontation, not by class struggle. On the contrary, the Trade Union also mobilizes and organizes for workers and employees to participate in building a clean and strong State.

At the same time, the Trade Union also protects the interests of the State - the State of the people, by the people, for the people. Fight against the bad habits of some backward and depraved people, fight against acts of violating state law, and protect the State government.

The current reality of our country, in the context of many components of goods, private enterprises, joint ventures, foreign-invested enterprises, workers, labor working under the management of enterprise owners (not state-owned enterprises), have seen the emergence of employer-worker relationships, and the situation of violations of the rights and interests of workers tends to develop. Therefore, the function of protecting the interests of workers, civil servants and laborers of the Trade Union is of utmost importance.

To perform the function of protecting interests, the Trade Union proactively participates with the government in finding jobs and creating working conditions for workers and laborers; The Trade Union participates in the field of salaries, bonuses, housing, in signing labor contracts of workers and laborers; representing workers and laborers in signing collective labor agreements; in negotiation and settlement of labor disputes; organizing strikes according to the Labor Code. Management and use of collective welfare funds and collective welfare careers; social insurance; labor protection; participation in resolving complaints and denunciations of workers, civil servants and laborers; promoting democracy, equality, social justice; developing cultural, artistic, sports, tourism, sightseeing and vacation activities.

In the process of implementing activities to perform the function of protecting interests, it is necessary to fully and deeply understand basic issues such as:

+ The interests of workers are associated with the interests of the State, of the collective, the existence of the State is the guarantee of interests for workers. The interests of workers are not only purely in food and clothing, but higher are political interests (represented by the State), economic interests, cultural and spiritual interests, immediate, daily, and long-term interests, personal and collective interests, and the State.

+ The State is the guarantor, the Trade Union is the protector of the interests of workers, civil servants and laborers. This is an important issue that speaks to the close, dialectical relationship between obligations and rights. At the same time, it is the basis for recognizing the interests of workers, civil servants and laborers in the new conditions, reflecting the true revolutionary nature of the Vietnam Trade Union.

- Second function, participating in state management, socio-economic management, participating in inspecting and supervising the activities of state agencies and economic organizations.

In the conditions where the working class wins power, workers become owners, they have the right and responsibility to participate in economic and social management. Therefore, the issue of participating in management has become a function of the Trade Union. However, it is necessary to recognize that the Trade Union participates in management but does not replace, does not obstruct, or brutally interfere in the management work of the State. Trade Union participation in management is essentially to exercise the rights of the Trade Union, the rights of workers, civil servants, and laborers, and to fully protect the rights and interests of workers.

Today, in the context of a socialist-oriented market economy, when performing the function of participating in management, the Vietnam Trade Union needs to pay attention to developing labor potential, promoting initiatives, and together with directors and heads of units to find capital and markets to expand production and business, and create jobs for workers. Inspect and supervise the activities of the government, and combat bureaucracy and corruption.

Contents that the Vietnam Trade Union participates in management

* Organizing a good labor emulation movement among workers, civil servants and laborers is a comprehensive measure for them to directly participate in management.

* Participate in building strategies to create jobs and working conditions for workers.

* Participate in building and perfecting regimes and policies directly related to employees such as: salaries, bonuses, housing...

* Participate in resolving complaints and denunciations of workers, civil servants and laborers.

* Participate in building and perfecting social policies: Social insurance, health insurance, population and family planning policies, gratitude movements, and social relief.

* Mobilize and organize well the Congress of civil servants and public employees, the Conference of cadres and civil servants (administrative and non-business units) at units.

* Trade unions participate in planning production, business and investment strategies, and at the same time inspect and supervise planned tasks.

* Participate in building and implementing policies related to the rights, interests and obligations of employees. Inspect and supervise the implementation of regimes and policies of the unit.

- The third function is to educate and encourage workers and employees to promote their right to master the country, fulfill their civic obligations, build and protect the Fatherland.

The educational function of the Vietnam Trade Union is increasingly expanded and developed through practical activities in production labor and participation in emulation movements... contributing to workers, civil servants and laborers to be aware and understand their interests associated with collective interests and the interests of society. To have benefits and want their own interests to be protected first, it is necessary to properly fulfill labor obligations, the obligations of citizens to agencies, enterprises and society. On that basis, build a new working consciousness, disciplined labor and industrial working style. Raise the spirit of self-awareness in studying culture, politics, expertise, and professional skills to meet the cause of industrialization and modernization of the country.

+ Trade unions propagate and educate workers, civil servants and laborers to firmly believe in the path of building socialism and developing socio-economy that our Party has chosen. Educate revolutionary traditions of the nation and locality (especially for young workers).

+ Propagating state policies and laws. Educating to improve professional ethics, labor discipline, industrial style, building a healthy cultural lifestyle, living and working according to the law, contributing to building a strong working class. With the spirit of constant vigilance and fighting against hostile plots.

The function of the Trade Union is a political entity, a synchronous system, in which the function of protecting interests is highly valued, has central significance, is the operating goal of the Vietnam Trade Union; the function of participating in management has means; the educational function has the meaning of creating spiritual motivation to achieve goals.

Therefore, the Vietnam Trade Union also pays attention to all 3 functions, not underestimating this function, but emphasizing that function.
