The draft revised Law on Social Insurance proposes to assign the Government to regulate the replacement and reduction of the components of dossiers and procedures for enjoying pensions and social insurance allowances.

According to the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH), the Government proposes to adjust regulations on dossiers and administrative procedures in the field of social insurance.

One of the notable contents is the proposal to abolish a number of articles on dossiers, order, and procedures in the 2024 Law on Social Insurance.

Specifically, in Clause 2, Article 2 of the draft Law, the Government proposes to abolish Articles 24, 27, 28, 29, 47, 48, 49, 61, 62, 63, 77, 78, 79, 80, 81, 90, 91, 92, 96, 97, 105, 106, 107, 112 and 113.

Along with proposing to abolish these regulations, the draft Law assigns the Government to regulate dossiers and procedures for participating in and enjoying social insurance benefits.

According to point b, clause 2, Article 3 of the draft, the Government is responsible for stipulating dossiers and procedures for participating in and enjoying social insurance regimes and dossiers and procedures for enjoying regimes for employees who are not eligible for pensions or are not old enough to receive social pension benefits.

Notably, the draft stipulates that the Government shall base on the level of response to the exploitation and use of national databases and specialized databases to regulate the replacement and reduction of dossier components in administrative procedures.

The goal is to ensure convenience for participants and beneficiaries of social insurance benefits such as pensions, social insurance allowances...

According to the Government's Submission, one of the purposes of amending the Law on Social Insurance is to simplify administrative procedures for people and businesses and create a legal basis for agencies in the policy implementation process.

However, the draft Law has not specifically listed which documents will be removed or replaced in each procedure.

The reduction of dossier components will depend on the detailed regulations of the Government and the level of response of the database system.

Appraising the draft Law, the Committee for Culture and Social Affairs also proposed that the Government pay attention to building regulations on administrative procedures in the direction of reducing time, components of dossiers, procedures and compliance costs.

The draft Law is expected to take effect from March 1, 2027 if approved by the National Assembly.
