Proposal to change regulations on the lowest pension level
The draft revised Law on Social Insurance proposes a minimum monthly pension level equal to the reference level for some groups with 20 years of compulsory social insurance contributions.
According to the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH) submitted by the Government to the National Assembly at the 2nd Session, 16th National Assembly, one of the notable contents is the proposal to amend regulations on the lowest monthly pension level.
In Clause 33, Article 1 of the draft Law, the Government proposes to amend Clause 11, Article 141 of the 2024 Law on Social Insurance.
Accordingly, subjects specified in points a, b, c, d, đ, g and i, clause 1, Article 2 of the Law on Social Insurance who have participated in social insurance before the amended Law takes effect, and have compulsory social insurance contributions for 20 years or more, the monthly pension level is at least equal to the reference level at the time of settlement for pension benefits.
Thus, the draft identifies three factors to note when applying this regulation: Belonging to the group of subjects cited in Clause 1, Article 2; Having participated in social insurance before the amended Law took effect; Having at least 20 years of compulsory social insurance contributions.
The lowest pension level is determined according to the reference level at the time of resolving pension benefits, not a fixed amount of money recorded in the amended content.
This is a regulation for specific groups of subjects, which does not mean that all social insurance participants or all retirees are applied the lowest pension level as above.
According to the Government's Submission, the draft Law amending and supplementing a number of articles of the Law on Social Insurance is built to ensure the consistency of regulations, in accordance with the arrangement of the organizational structure and create a legal basis for the process of implementing social insurance regimes and policies.
The draft Law is expected to take effect from March 1, 2027 if approved by the National Assembly.
