The draft revised Law on Social Insurance proposes to add people currently receiving monthly social pension benefits to groups that are not subject to voluntary social insurance participation.

One of the contents proposed by the Government in the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH) is to adjust regulations on social insurance participants.

Accordingly, at point b, clause 1, Article 1 of the draft Law, the Government proposes to amend point a, clause 4, Article 2 of the 2024 Law on Social Insurance regarding voluntary social insurance participants.

The draft stipulates that Vietnamese citizens aged 15 and over are not subject to compulsory social insurance participation and are not people who are receiving pensions, social insurance allowances, monthly allowances, and monthly social pension allowances that are subject to voluntary social insurance participation.

Thus, people currently receiving monthly social pension benefits are clearly mentioned in the group that is not subject to voluntary social insurance according to the draft content.

In addition, the draft also amends point a, clause 7, Article 2, adding people currently receiving monthly social pension benefits to the group not subject to compulsory social insurance participation.

For people who are receiving social insurance allowances and monthly allowances, the draft assigns the Government to specifically stipulate subjects who are not subject to compulsory social insurance participation.

The proposed regulations are aimed at clearly defining the scope of subjects participating in compulsory social insurance, voluntary social insurance and cases not eligible for participation.

According to the draft Law, the amended contents are expected to take effect from March 1, 2027 if approved by the National Assembly.
