The draft revised Law on Social Insurance proposes that social insurance books be issued in electronic form, while paper copies are still issued on request and have equivalent legal value.

According to the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH) submitted by the Government to the National Assembly at the 2nd Session, 16th National Assembly, regulations on the form of issuing social insurance books are one of the proposed amendments.

Specifically, Clause 8, Article 1 of the draft Law proposes to amend Clause 2, Article 25 of the 2024 Law on Social Insurance.

According to the draft content: "Social insurance books are issued in electronic form. Paper social insurance books are issued when social insurance participants request and have legal value as electronic copies".

Thus, the draft continues to identify electronic social insurance books as the form of issuance of books, and at the same time clearly stipulates that participants have the right to request the issuance of social insurance books in paper form.

Notably, the paper copy of the social insurance book issued upon request has the same legal value as the electronic copy. The proposed content does not stipulate the complete removal of the paper copy of the social insurance book.

In addition to regulations on the form of certificate issuance, the draft Law also proposes to amend and supplement regulations on dossiers and administrative procedures in the field of social insurance.

Accordingly, some detailed regulations on dossiers and procedures are proposed to be abolished from the Law and assigned to the Government for regulation.

In Article 3, the draft assigns the Government to base on the level of response to the exploitation and use of national databases and specialized databases to stipulate the replacement and reduction of dossier components in administrative procedures.

The goal stated in the draft is to ensure convenience for participants and beneficiaries of social insurance benefits.

According to the Government's Submission, the amendment and supplementation of the Law on Social Insurance aims to simplify administrative procedures, create favorable conditions for policy implementation and ensure the consistency of the legal system.

The draft Law is expected to take effect from March 1, 2027 if approved by the National Assembly.
