The draft Law on Food Safety (amended) proposes to remove specific regulations on inspection in this Law to implement according to the general regulations of the Law on Inspection.

According to the plan, at the 2nd Session, the 16th National Assembly will consider and pass the draft Law on Food Safety (amended).

The Government's submission to the National Assembly shows that the draft Law consists of 74 Articles, 9 Chapters, and 2 Appendices.

This Law stipulates food safety; rights, obligations and responsibilities of organizations and individuals in ensuring food safety; food safety data information system; food safety testing; food safety post-inspection.

This draft law amends and completes the risk analysis on food safety as a basis for deciding to apply or adjust appropriate management measures.

At the same time, amend and supplement the state management responsibilities of the Ministries of Health, Agriculture and Environment, Industry and Trade and related ministries and sectors.

Along with that, the draft has supplemented the obligations of businesses when doing business in the form of e-commerce; regulations on food safety information data systems; regulations that food business establishments must meet good hygiene conditions (GHP), meeting advanced food management systems such as GMP, HACCP, ISO 22000.

At the same time, regulations on food after harvesting, catching, exploiting, and slaughtering must meet the limit level of veterinary drug residues, pesticides and pollutants in food.

In particular, regulations stipulate that processing and food service business establishments (including collective meal providers) must store records, commitments, and notify local authorities.

Notably, this amendment has omitted some contents such as removing some rights and obligations of consumers because they have been stipulated in other legal documents (Article 11 of the draft Law).

Abolish specific regulations on inspection because it is implemented according to the Law on Inspection (Article 57 of the draft Law). At the same time, abolish regulations on testing because it is no longer consistent with the current legal system.
