New proposal on units responsible for managing social pension policies
The draft revised Law on Social Insurance proposes to supplement the responsibility of the Ministry of Health in developing, guiding, inspecting and handling violations of social pension allowances.
According to the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH), the Government proposes to supplement regulations on the responsibility of the Ministry of Health for social pension benefits policies.
Specifically, Clause 30, Article 1 of the draft Law proposes to add Article 137a after Article 137 of the 2024 Law on Social Insurance, stipulating the responsibilities of the Ministry of Health.
Accordingly, the Ministry of Health is responsible for developing and submitting to competent authorities for promulgation or promulgation according to its authority policies and laws on social pension benefits.
The Ministry of Health is also responsible for propagating, disseminating, and educating the law on social pension allowances; directing and guiding the organization of the implementation of policies and laws on this regime.
Notably, the draft stipulates that the Ministry of Health is responsible for inspecting and handling violations of the law and resolving complaints and denunciations about social pension benefits.
In addition, the Ministry of Health presides over the development of content on the implementation of policies and social pension allowance regimes, and sends it to the Ministry of Home Affairs for synthesis and development of a Government report according to the provisions of Clause 5, Article 135 of the Law on Social Insurance.
Thus, the draft proposes to specifically define the responsibility of the Ministry of Health for policy development, implementation guidance, inspection and synthesis of the situation of implementing social pension benefits.
This content is in the group of regulations proposed by the Government to amend and supplement to be consistent with the arrangement of the organizational structure, functions and tasks of state management agencies.
According to the Government's Submission, the amendment of the Law on Social Insurance aims to ensure uniformity in the legal system, creating a legal basis for agencies and organizations to implement regimes and policies.
The draft Law is expected to take effect from March 1, 2027 if approved by the National Assembly.
