New regulations on transferring cadre ranks to specialist ranks for commune civil servants
Civil servants holding cadre ranks who are assigned to positions that require specialist ranks can be transferred to higher ranks if they meet the conditions.
Ms. Quynh Nga (Gia Lai) before the merger of communes and wards was a civil servant accountant at the Commune People's Committee, holding the cadre rank (01.004). After July 1, 2025, she was transferred to work as an accountant at the Commune Party Committee office.
In July 2025, Ms. Nga graduated from university and submitted a dossier requesting transfer from civil servant to specialist (01.003). However, the Commune Party Building Committee said that there are no specific instructions on this case and the consideration and decision are under the authority of the competent authority of the Provincial Party Committee.
Ms. Nga asked, is the unresolved transfer of rank in accordance with regulations and is her case transferred from official to specialist or not?
According to the Ministry of Home Affairs, current regulations determine that civil servants assigned to which job positions are ranked according to that job position. The ranking for professional and nghiệp vụ civil servants must be based on the job description and the capacity framework of the job position.
Notably, when civil servants are assigned to job positions with ranks higher than the current rank, the conditions for implementation are according to the provisions of Decree No. 170/2025/ND-CP, amended and supplemented in Decree No. 300/2026/ND-CP.
According to the Ministry of Home Affairs, this case does not require civil servants to have a time holding a lower rank than the adjacent one or to work in the same industry or field as previously regulated for civil servant promotion exams and considerations.
Thus, a civil servant holding a cadre rank with a university degree does not automatically mean being transferred to the specialist rank. Ranking must be linked to the job position that the civil servant is assigned and the requirements for capacity and standards of that position.
The Ministry of Home Affairs said that when arranging civil servants for professional and nghiệp vụ positions with ranks ranked higher than the current rank, the head of the agency using civil servants must develop a plan to change the job position and report to the civil servant management agency for unification before implementation.
The plan must clearly define evaluation criteria, principles and methods of selecting civil servants to be assigned to new job positions, ensuring compliance with the specific operations of agencies and units.
In addition to the requirements specified in the job description and competency framework of the job position, the civil service agency may provide additional criteria to select suitable people for positions with higher ranks.
The selection of civil servants is carried out in order of evaluation results from highest to lowest, ensuring publicity, transparency, objectivity and compliance with regulations.
Therefore, in the case of Ms. Quynh Nga, the transfer from cadre to specialist rank is not only based on university graduation but must also consider the current job position, the standards of the position and the plan to change the job position of the agency.
The Ministry of Home Affairs requests Ms. Nga to contact the civil servant management agency where she works for consideration and settlement according to its authority, based on the provisions of Article 67 and Article 68 of Decree No. 170/2025/ND-CP.
