Lam Dong authorizes the head of a specialized agency directly under the province to resolve the resignation of civil servants who do not hold leadership or management positions.

On November 2nd, Lam Dong Provincial People's Committee said that it had just issued Decision No. 5130/QD-UBND on authorizing the dismissal of civil servants, in order to increase proactiveness in the process of arranging and assigning personnel.

According to the decision, the Chairman of the Provincial People's Committee authorized the heads of specialized agencies under the Provincial People's Committee and the Heads of the Provincial Industrial Parks Management Board to resolve the resignation of civil servants who do not hold leadership or management positions within the assigned payroll.

The authorization is based on Decree No. 300/2026/ND-CP dated July 29, 2026 of the Government on amending and supplementing a number of regulations related to the recruitment, use and management of civil servants.

Accordingly, the head of the competent recruiting agency is allowed to decide to dismiss civil servants who do not hold leadership or management positions.

According to the Department of Home Affairs, authorization is necessary while the province has not issued a decision to decentralize management of new cadres, civil servants, and public employees.

This mechanism helps units proactively resolve work for civil servants under direct management.

The above move takes place in the context that the province is arranging and assigning personnel according to the 2026 payroll roadmap.

According to Resolution No. 52/NQ-HĐND dated September 24, 2026 and Decision No. 4753/QD-UBND dated September 30, 2026, the number of staff from December 31, 2026 will decrease compared to the previous period.

Agencies and units are developing personnel arrangement plans, including resolving resignation of civil servants according to their wishes.

Decision No. 5130/QD-UBND takes effect from the date of signing to the end of December 31, 2026.

Heads of authorized agencies are not authorized to re-entrust tasks; the resolution of resignation must comply with the correct order, procedures and current regulations.

The Department of Home Affairs is responsible for monitoring, guiding, and inspecting the implementation; summarizing contents beyond its authority to report and propose to competent authorities for consideration.

The head of the authorized agency is responsible before the law and the Chairman of the Provincial People's Committee if it does not comply with regulations.
