Ministry of Public Security guides steps to apply for a paper Judicial Record Certificate

The Ministry of Public Security said that, according to the Law on Judicial Records, Judicial Record Certificates are issued in electronic or paper form and have the same legal value.

Stemming from practical needs and to ensure the legitimate rights of Vietnamese citizens when carrying out related procedures with foreign diplomatic missions in Vietnam, the Ministry of Public Security temporarily additionally issues a maximum of 2 paper and free Judicial Record Certificates to citizens who have been issued Electronic Judicial Record Certificates when that citizen simultaneously proves 2 conditions:

Prove the purpose of using a paper Criminal Record Certificate to carry out procedures with foreign diplomatic missions (For example: Applying for labor export, settlement, studying abroad, naturalization abroad... with documents proving that it is a labor supply contract; Labor contract with employers abroad; Admission notice;...);

Procedures of foreign diplomatic missions require citizens to present a paper criminal record certificate (For example: List of documents or components of applications for labor export or study abroad, settlement... requiring original or paper criminal record certificates).

Regarding the order and procedures for implementation, they have been publicly posted at the One-Stop Shop of the Professional Records Department and the Provincial Police.

Citizens can request the issuance of a paper Judicial Record Certificate directly at the competent authority issuing the Judicial Record Certificate or online on the Judicial Record Information Management System, the steps are as follows:

Citizens should directly go to the competent authority to issue the Judicial Record Certificate or use the level 2 electronic identification account to log in to the Judicial Record Information Management System at https://lltp. bocongan. gov. vn to look up the issued electronic Judicial Record Certificate and carry out procedures to request the issuance of a paper Judicial Record Certificate.

In case of direct visit to the competent authority issuing the Judicial Record Certificate, citizens present papers and documents proving the purpose of applying for a paper Judicial Record Certificate and proving the request for a paper Judicial Record Certificate from a foreign diplomatic mission in Vietnam;

In case of implementation on the Criminal Record Information System, citizens attach a scanned copy of the above-mentioned proof documents to complete the procedures for requesting the issuance of a paper Criminal Record Certificate;

The competent authority issuing the Judicial Record Certificate shall print, sign for approval and stamp on the paper Judicial Record Certificate to ensure the correct content and time of issuance according to the Electronic Judicial Record Certificate issued to citizens; the total time for issuing supplementary paper Judicial Record Certificates is no more than 8 working hours from the time people complete Step 2.

The competent authority issuing the Judicial Record Certificate returns the results directly or through postal services at the request of citizens.
