Today, October 19, the National Assembly will discuss in groups the draft Penal Code (amended) and the draft Resolution of the National Assembly on the implementation of the Penal Code (amended).

Today (October 19), according to the program of the 2nd Session, the National Assembly will spend almost the whole day discussing in groups on many important contents.

In which, the National Assembly will discuss in groups about the draft Law on Property Auction (amended); draft Law on Lawyers (amended); draft Law on Adopting Children (amended).

In particular, the National Assembly spent an afternoon discussing in groups the draft Penal Code (amended) and the draft Resolution of the National Assembly on the implementation of the Penal Code (amended); the draft Law on Organization of Criminal Investigation Agencies (amended).

Regarding the Penal Code (amended), on October 17, General Luong Tam Quang - Member of the Politburo, Minister of Public Security, authorized by the Prime Minister to present a report on receiving, explaining and revising the draft Penal Code.

Minister of Public Security Luong Tam Quang said that the drafting agency has researched, evaluated and revised many contents after receiving opinions from National Assembly deputies, the National Assembly Standing Committee, the Law and Justice Committee, and agencies, organizations and people.

One of the notable contents is the adjustment of penal policies for commercial legal entities and individuals committing crimes in the name of commercial legal entities.

According to the report, the drafting agency has revised the draft in the direction of removing the penalty of temporary suspension of operations and reducing fines for commercial legal entities in some crimes.

The goal is to avoid handling too heavily, affecting production, business and labor activities.

For individuals committing crimes under the guise of commercial legal entities, the draft also removes the mechanism to determine the penalty level in proportion to the case of individuals committing independent acts correspondingly.

Instead, the court will decide the penalty based on the role, severity of the fault, motive, purpose and benefits that the individual obtains. This approach focuses on specifically assessing the nature, severity and responsibility of each person in the criminal act.

Along with that, the drafting agency revised and supplemented regulations on the principle of leniency and deciding on penalties below the lowest level of the penalty frame for offenders who voluntarily confess and accept punishment, in order to ensure consistency with the draft Criminal Procedure Code.

The report also said that the draft has absorbed and revised many other important contents, from cases of excluding criminal liability, postponing prosecution and exemption from criminal liability to the scope of criminal liability of commercial legal entities, acts of preparing to commit crimes and the addition and removal of some crimes.

In the section on specific crimes, the drafting agency continues to study and revise regulations related to the environment, network security, intellectual property and many other fields, in order to ensure comprehensive, practical, synchronous and unified regulations on legislative techniques.
