Dismissed under Decree 178, many officials hope to continue paying social insurance to receive a 75% pension

Some officials, civil servants, and employees retiring under regime 178 expressed their wish to continue paying social insurance to fully enjoy the 75% pension level.

On October 3, the National Assembly's Committee for Culture and Society held a plenary session to review the draft Law amending and supplementing a number of articles of the Law on Social Insurance (BHXH).

At the meeting, Deputy Chairman of the Culture and Social Affairs Committee Ta Van Ha said that some officials, civil servants, and employees who retired to enjoy Decree 178 regimes did not have enough years of social insurance contribution according to regulations, so at the time of retirement, the pension level was low.

Therefore, many people expressed their desire to have a mechanism to continue paying social insurance to fully enjoy the maximum monthly pension of 75% of the average salary level used as the basis for social insurance contributions.

According to Deputy Chairman of the Committee for Culture and Social Affairs Ta Van Ha, this content is currently not regulated, but in reality it has been raised, so in the law amendment, it is necessary to study and consider supplementing it.

Exchanging this content, Director of the Department of Salary and Social Insurance (Ministry of Home Affairs) Pham Truong Giang said that there are 2 groups resigning under Decree 178.

The first group is cases of receiving lump-sum allowances and enjoying retirement benefits.

The second group is those who receive a one-time allowance and have not yet enjoyed retirement benefits. For this group, according to Mr. Giang, they will continue to work and pay social insurance.

Mr. Pham Truong Giang added information about the social insurance model of some countries, including the pension structure, accumulation, and the ratio between contribution and benefit levels of some countries and Vietnam.

Previously, according to Vietnam Social Security, people retiring early under Decree 67, amended and supplemented by Decree 178, are entitled to pensions according to the provisions of the Law on Social Insurance without being deducted from the pension rate.

However, the benefit rate must still be based on the current Law on Social Insurance. In which, male workers receive a rate of 45% corresponding to 20 years of social insurance contribution. Female workers receive a rate of 45% corresponding to 15 years of social insurance contribution.

Then for each additional year of social insurance contribution, employees are calculated an additional 2% until reaching a maximum level of 75%. Thus, male workers must have 35 years of social insurance contribution, female workers must have 30 years of social insurance contribution to receive a maximum pension of 75% of salary calculated according to the levels when they were still working.

According to the answer of Thai Nguyen Provincial Social Insurance, in case employees quit their jobs according to the regime of Decree 178 and have already enjoyed retirement benefits, they are not required to pay social insurance. In case they have not yet enjoyed retirement benefits and have signed a labor contract with the agency, they continue to pay social insurance.

According to information from the Ministry of Home Affairs, by December 2025, payment and implementation of regimes and policies according to Decree 178 (amended and supplemented in Decree 67) have been completed.

Statistics at that time showed that the whole country had 146,839 people who had resignation decisions (47,913 people at the central level and 98,926 people at the local level).

Of which, the number of people enjoying early retirement policy is 71,610 people and 75,237 people enjoy retirement policy.
