Notes on procedures for terminating unemployment benefits when having a new job
The Social Insurance Agency has stated the things to note when workers who are receiving unemployment benefits have new jobs.
Vietnam Social Security said that, according to the provisions of Clause 1, Article 19 of Decree No. 374/2025/ND-CP dated December 31, 2025 of the Government, employees are determined to have jobs when concluding a labor contract (or working contract) for 1 month or more. The date determined to have jobs is the legal effective date of the labor contract recorded in the contract.
Within 3 working days from the date the labor contract takes effect (the date it is determined to have a job), the employee is responsible for notifying the public employment service organization where they are receiving unemployment benefits (TCTN).
Employees submit notifications according to Form No. 17 directly or through the National Public Service Portal, accompanied by a copy of the signed labor contract.
In case a copy of the labor contract has not been received, the employee must make a commitment stating the effective date of the labor contract, the reason for not being able to provide a copy of the labor contract and is responsible for submitting an additional copy of the labor contract within 3 working days from the date of receipt of the contract.
When employees implement the notice of termination of unemployment benefits in accordance with regulations, the unemployment insurance contribution period that has been paid but has not yet received unemployment benefits will be preserved as a basis for calculating benefits for the next time.
If employees do not comply with the notice according to regulations, they will not be allowed to preserve the unemployment insurance contribution period, and will also be administratively sanctioned and forced to return to the social insurance agency the amount of unemployment benefits received in violation of regulations.
Businesses are responsible for handing over labor contracts to employees within 2 working days so that they can carry out procedures to notify the public employment service agency.
At the same time, enterprises shall prepare and submit dossiers for registration/reporting of compulsory social insurance increases (including social insurance, health insurance, unemployment insurance, occupational accident and disease insurance) for employees within 30 days from the date of being subject to compulsory social insurance (date of labor contract effective date).
The registration to participate in compulsory social insurance for employees must be carried out fully and on time. In case of late registration, late payment or evasion of social insurance and unemployment insurance, businesses may be handled according to the provisions of law, and must fully fulfill financial obligations arising from late payment.
