People currently receiving unemployment benefits who have new jobs need to pay attention
Currently receiving unemployment benefits but signing a labor contract for a full month, the employee must notify to terminate the benefits in accordance with regulations.
Being identified as having a job from the date the contract takes effect
According to Clause 1, Article 19 of Decree 374/2025/ND-CP of the Government, employees are identified as having jobs when concluding a labor contract or working contract of 1 month or more.
The time to be determined to have a job is the date the contract takes effect according to the content recorded in the contract.
This regulation is especially noteworthy for people who are receiving unemployment benefits but have found a new job.
Must notify within 3 working days
From the date the labor contract takes effect, employees have 3 working days to notify the public employment service organization where they are receiving unemployment benefits.
Employees who make notifications according to Form No. 17 can submit them directly or through the National Public Service Portal, with a copy of the signed labor contract.
In case a copy of the contract has not been delivered by the enterprise, the employee may make a commitment, clearly stating the effective date of the contract and the reason for not being able to provide the contract. After receiving the contract, the employee must supplement a copy within 3 working days.
Notifying on time helps employees terminate unemployment benefits in accordance with regulations. At the same time, the period of unemployment insurance contribution but not yet receiving benefits will be preserved as a basis for calculating benefits for the next time.
Conversely, if not notified according to regulations, employees may not be allowed to preserve the unemployment insurance contribution period, be administratively sanctioned and have to return the unemployment benefits received in violation of regulations.
Businesses must hand over contracts to employees
On the business side, employers are responsible for handing over labor contracts to employees within 2 working days so that employees have a basis to carry out notification procedures.
Businesses must also register and report increased participation in compulsory social insurance for employees, including social insurance, health insurance, unemployment insurance and occupational accident and disease insurance.
Registration documents for participation must be made within 30 days from the date the employee is subject to compulsory social insurance, i.e., the date the labor contract takes effect.
Businesses that are late in registering, late in paying or evading social insurance and unemployment insurance may be handled according to regulations and must fully fulfill financial obligations arising from late payment.
