Deceiving to receive monthly social allowances is fined up to 5 million VND

Clause 3, Article 7, Decree 98/2026/ND-CP stipulating penalties for administrative violations in the field of social protection, social assistance and children (effective from May 16, 2026) stipulates a fine of between 3 million VND and 5 million VND for one of the following acts:

a) False declaration to receive monthly social allowances but not to the extent of criminal prosecution;

b) False declaration to receive monthly social pension benefits but not to the extent of criminal prosecution;

c) False declaration to receive monthly care and nurturing support but not to the extent of criminal prosecution;

d) False declaration to be admitted to care and nurturing at social assistance facilities, child protection service providers, elderly care facilities, care facilities for people with disabilities, and victim support facilities.

Clause 4, Article 7, Decree 98/2026/ND-CP stipulates remedial measures as follows: Forcing the return of illegal profits obtained from the act of violating the provisions of Clause 1, Clause 2, Point a, Point b, Point c Clause 3 of this Article;

Clause 2, Article 6 of Decree 98/2026/ND-CP stipulates: The fine level specified in Chapter II of this Decree is the fine level applied to administrative violations of individuals, except for Articles 10, 11, 14, 15, 16, 34, Clause 1, Clause 2, Article 35 and Clause 2, Article 37 of this Decree. For the same administrative violation, the fine level for organizations is twice the fine level for individuals.

Thus, from May 16, 2026, people who intentionally falsely declare to receive monthly social allowances but not to the extent of criminal prosecution will be fined up to 5 million VND. In addition, they will also be forced to return the illegal profits obtained from the violation.
