In case of miscarriage or stillbirth, female workers can still enjoy social insurance benefits with leave and allowance levels according to regulations.

According to Vietnam Social Security, female workers participating in compulsory social insurance are entitled to benefits when there is miscarriage, abortion, fetal death in the womb, fetal death during labor or ectopic pregnancy. The leave period is prescribed by the medical examination and treatment facility but is calculated at the maximum gestational age.

Specifically, pregnancies under 5 weeks are entitled to a maximum of 10 days of rest; from 5 to under 13 weeks, a maximum of 20 days; from 13 to under 22 weeks, a maximum of 40 days; from 22 weeks of age and older, a maximum of 50 days. The rest period includes holidays, Tet and weekly days off.

Notably, in cases of pregnancy from 22 weeks of age or older, if a female worker is eligible for maternity benefits, both the mother and the husband are entitled to maternity benefits as in the case of giving birth.

The monthly maternity benefit level is equal to 100% of the average salary used as the basis for compulsory social insurance contributions for the last 6 months before retirement. If social insurance contributions are less than 6 months, the average level is calculated based on the months already contributed.

After the rest period ends, if health has not recovered, within 30 days, female workers can have a rest and health recovery period of up to 5 days. The allowance level is equal to 30% of the reference level per day. With a reference level of 2.53 million VND, the corresponding benefit is 759,000 VND/day.

Regarding records, if inpatient treatment, employees need a discharge paper, a summary of medical records or documents proving the treatment process. In case of outpatient treatment, a certificate of retirement to enjoy social insurance benefits is required.

The Social Insurance agency resolves within 7 working days from the date of receiving sufficient dossiers sent by the employer; in case the employee submits directly, it is 5 working days.

Workers can follow the status of their dossiers on the Vietnam Social Insurance Public Service Portal or look up benefit information on the VssID application, in the "Sickness, Maternity, Health recovery" section.
