Ministry of Home Affairs responds to recommendations on the wage coefficient of 3.33 for contract workers

HƯƠNG NHA (báo lao động) 01/11/2026 08:24 (GMT+7)

The Ministry of Home Affairs has responded to recommendations related to the application of a salary coefficient of 3.33 and a salary grade increase regime for contract workers.

Ms. Nguyen Thi Thuy (character name changed) said that she started working under a labor contract as an accountant from September 2011 to now, with a total working time of nearly 15 years and has transferred to 3 units. She has a university degree in accounting.

Before Decree 111/2022/ND-CP took effect, she was ranked for salary and increased salary to a coefficient of 3.33 in October 2023, from a coefficient of 3.00 to a coefficient of 3.33.

However, when Decree 111/2022/ND-CP took effect, she was not allowed to continue to be promoted in salary. The funds allocated to the unit to pay salaries for her job position are calculated according to a coefficient of 2.34. The difference between the coefficient of 3.33 and the coefficient of 2.34 is calculated by the unit using operating funds to pay.

From October 2023 to now, she has not been promoted to the next salary grade. Meanwhile, the labor contract still records the salary level according to a coefficient of 3.33 and the unit has a decision to assign the number of contracts from competent authorities.

To ensure the legitimate rights and interests of employees, and at the same time ensure the management and use of funds at the unit in accordance with regulations, Ms. Thuy proposed to clarify two issues:

First, is the application of a salary level with a coefficient of 3.33 suitable for labor contracts, contract assignment decisions and current legal regulations?

Second, what is the legal and financial basis for using the unit's operating funds to pay the difference between the coefficient of 3.33 according to the labor contract and the coefficient of 2.34 in the allocated funds?

Regarding Ms. Thuy's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Accordingly, on June 26, 2026, the Government issued Decree No. 235/2026/ND-CP (replacing Decree No. 111/2026/ND-CP).

Point d, Clause 2, Article 11 of Decree No. 235/2026/ND-CP stipulates that the salary in the contract is applied in one of two forms: the salary level according to agreement, in accordance with labor law or the salary according to the salary scale of public employees, in accordance with the financial capacity of the unit.

In case of applying the salary scale of public employees, the application of allowances, salary grade promotion regimes and other regimes and policies related to salaries are implemented according to the agreement in the contract.

In addition, Article 13 of Decree No. 235/2026/ND-CP stipulates implementation costs.

Based on the above regulations, the Ministry of Home Affairs requests citizens to study Decree No. 235/2026/ND-CP and contact the agency or unit where the contract is signed for guidance and resolution.
