From December 15, 2026, abolishing the regulation on annual leave pay for cadres, civil servants, public employees and contract workers in the public sector.
From December 15, 2026, regulations on the annual leave pay regime in Circular 141/2011/TT-BTC and amended and supplemented documents will be officially abolished. The subjects affected are cadres, civil servants, public employees and contract workers working in agencies and units using state budget funds.
On October 28, 2026, the Minister of Finance issued Circular 158/2026/TT-BTC on abolishing a number of legal normative documents under the authority of the Minister of Finance. The Circular takes effect from December 15, 2026.
Notably, in Clause 10 and Clause 16, Article 1, Circular 158/2026/TT-BTC stipulates the abolition of the entire Circular 141/2011/TT-BTC and Circular 57/2014/TT-BTC dated May 6, 2014 on the annual leave payment regime.
According to Article 1 of Circular 141/2011/TT-BTC, this policy previously applied to cadres, civil servants, public employees and contract workers according to the provisions of law, working in state agencies, public non-business units, socio-political organizations, socio-political-professional organizations, social organizations and socio-professional organizations using funds allocated by the state budget.
Circular 141 stipulates two groups of expenses to be paid when taking annual leave, including travel expenses, travel allowances when taking leave and salaries or allowances for unpaid or incomplete annual leave days.
In which, travel expenses and travel allowances are applied according to specific conditions. People working in highlands, remote areas, border areas, and islands with a regional allowance coefficient of 0.5 or more and some cases mobilized to the plains can be paid when they meet the conditions. For people working in other areas, payment is considered when taking leave to visit wives or husbands, children, parents of both sides who are sick or have passed away.
For unpaid leave days, cadres, civil servants, and public employees may be paid allowance if due to work requirements, agencies or units cannot arrange or do not arrange enough leave time. The expenditure level is based on funding sources and internal spending regulations, and does not exceed the overtime salary on Saturdays and Sundays. In case they have been arranged to take leave but individuals do not need to take leave, they will not be paid.
Thus, from December 15, 2026, all regulations in the two circulars mentioned above are no longer valid. The abolition applies to groups of cadres, civil servants, public employees and contract workers within the scope of regulation of Circular 141/2011/TT-BTC previously.
