Prohibited acts in civil judgment enforcement

The National Assembly has passed the Law on Civil Judgment Enforcement. This Law takes effect from July 1, 2026.

This Law stipulates the principles, order, and procedures for enforcement of judgments, decisions, and judgments according to the provisions of law; organization and operation of the civil judgment enforcement system, enforcement offices, civil judgment enforcement offices; duties, powers, and responsibilities of relevant agencies, organizations, and individuals in enforcement of civil judgments...

According to the provisions of the Law, agencies, organizations and individuals in civil judgment enforcement are responsible for promptly implementing decisions on judgment enforcement, documents, requests and proposals of civil judgment enforcement agencies... according to the provisions of law.

In case of resistance or obstruction of the enforcement of a judgment, the civil enforcement agency shall request the police agency to ensure order and safety according to the provisions of law.

The law also stipulates supervision of civil judgment enforcement activities. Accordingly, the National Assembly, the National Assembly Standing Committee, the Ethnic Council, the National Assembly Committees, the National Assembly Delegations, National Assembly deputies, People's Councils at all levels, the Vietnam Fatherland Front and affiliated socio-political organizations, within the scope of their tasks and powers, shall supervise the activities of civil enforcement agencies, civil enforcement offices and other state agencies in the enforcement of civil judgments in accordance with the provisions of law.

The law stipulates strictly prohibiting agencies, organizations and individuals from performing acts such as not complying with judgments and decisions;

Failure to comply with the decisions and requests of civil enforcement agencies, enforcement agencies, civil enforcement offices, and enforcement agency; resist, delay or cause difficulties or hinder the organization of enforcement;

Receiving bribes; illegally appropriating and using evidence, money, and assets to enforce judgments; destroying sealing, consuming, bribing, hiding, destroying, dispersing evidence and assets temporarily detained, changing the status, transferring ownership and use of assets to enforce judgments;

Or strictly prohibit intentional decision not to enforce the judgment or make decisions on illegal execution of the judgment; apply measures to enforce illegal execution of the judgment;

Taking advantage of or abusing positions and powers to obstruct or illegally intervene in the settlement of enforcement of judgments or taking advantage of their influence to affect those responsible for enforcement of judgments and decisions; intentionally enforcing in violation of the content of judgments and decisions; taking advantage of or abusing positions and powers to illegally execute judgments and delay the execution of judgments;

Forgery, falsification of documents, records, information, electronic data to evade the obligation to enforce the judgment or prolong the time of organizing the enforcement; disclosure of information or taking advantage of, abusing information about the accounts, income, and assets of people subject to enforcement to illegally use or affect the enforcement of the judgment;

Irresponsible, intentional delays in leading, directing, and implementing the work of protecting agencies, organizations, and civil servants in enforcement activities.
