Commune-level People's Committees are allowed to specifically decide on the number of Deputy Heads of Departments

The Government has issued Decree No. 370/2025/ND-CP regulating the Head of Department and Deputy Head of Department under the People's Committees (UBND) of communes, wards and special zones of provinces and cities.

The Decree stipulates that the head of the department under the People's Committee at the commune level (Department Head) is appointed by the Chairman of the People's Committee at the commune level, responsible before the People's Committee at the commune level, the Chairman of the People's Committee at the commune level and before the law for performing the functions, tasks and powers of the department.

The deputy head of the department under the People's Committee at the commune level (Deputy Head of the department) is the person who helps the Head of the Department direct some aspects of work and is responsible to the Head of the Department for assigned tasks. When the Head of the Department is absent, the Deputy Head of the Department is authorized by the Head of the Department to manage the activities of the Department.

The number of Deputy Heads of Departments is calculated on the principle of an average of 2 deputy heads/department.

Based on the above regulations and the number of specialized departments established, the People's Committees at the commune level shall specifically decide on the number of Deputy Heads of each specialized department under their management.

Decree No. 370/2025/ND-CP also amends and supplements Clause 1, Article 11 of Decree No. 150/2025/ND-CP regulating the position and functions of specialized departments at the commune level.

According to the new regulations, the department is a specialized agency under the People's Committee at the commune level. The Department has its own seal and account according to the provisions of law to perform assigned tasks; perform the function of advising, helping the People's Committees at the commune level to state management of local sectors and fields according to the provisions of law.

The Economic Department (for communes and special zones) or the Economic, Infrastructure and Urban Affairs Department (for wards and special zones of Phu Quoc) advise and help the People's Committees at the commune level perform the function of state management in the following areas:

Finance - Plan (finance - state budget; plan and investment; statistics; business household registration; support for businesses, collective economic organizations...);

In the field of Construction and Industry and Trade (construction planning, architecture; construction investment activities; urban development; urban technical infrastructure; housing; offices; construction materials; transportation...);

Agriculture and Environment (land; water resources; mineral resources; environment; seas and islands; agriculture; forestry...).

The Department of Culture and Social Affairs advises and assists the People's Committees at the commune level in performing state management functions on:

Education and Training (preschool education; general education (primary education and secondary education).
