The Government aims to increase the number of specialized departments under the People's Committees at the commune level
The Government stipulates that the Provincial People's Committee decides on the number of specialized departments at commune-level administrative units, not exceeding the average of 4.5 organizations.
The Government has just issued Decree No. 370/2025/ND-CP regulating the organization of specialized agencies under the People's Committees of provinces and cities and the People's Committees of communes, wards and special zones under provinces and cities.
Regarding the number of specialized departments under the People's Committee at the commune level, Decree No. 150/2025/ND-CP currently stipulates the number of specialized departments under the People's Committee at the commune level, including 3 specialized departments and public administrative service centers.
However, in the process of operating the two-level local government, there are many proposals and recommendations to increase the number of specialized departments under the People's Committees at the commune level to promptly resolve procedures and serve the essential needs of the people.
Therefore, Decree No. 370/2025/ND-CP has stipulated the increase in the number of specialized departments under the People's Committees at the commune level.
This increase is based on the groups of sectors and fields specified in Article 15 of Decree 150/2025/ND-CP and the criteria for classifying administrative units, population size, natural area, development level, socio-economic conditions, decentralization, delegation of authority between local government levels and specific factors of each type of administrative unit.
Accordingly, the Provincial People's Committee decides on the number and names of specialized departments applied to commune-level administrative units under its management, ensuring that they do not exceed the average of 4.5 organizations (including: specialized departments and Public Administration Service Centers) per commune-level administrative unit; Hanoi and Ho Chi Minh City alone ensure that they do not exceed the average of 4.7 organizations (including: specialized departments and Public Administration Service Centers) per commune-level administrative unit.
The decision to establish specialized departments is decided by the local government at the commune level.
In case the commune-level administrative units do not establish a specialized department, arrange specialized civil servants to advise and help the commune-level People's Committees manage the sector and field according to regulations.
The Public Administration Service Center under the People's Committee at the commune level shall comply with Government regulations.
Decree No. 370/2025/ND-CP stipulates that the People's Committees at the commune level submit to the People's Councils at the same level a decision to establish, reorganize, and dissolve other professional departments and administrative organizations under the People's Committees at the commune level according to the provisions of law.
Specifically stipulate the functions, tasks, and powers of the professional department in accordance with the instructions of the Provincial People's Committee, the Ministry managing the sector and field; based on the number of established professional departments and the average number of Deputy Heads of the department according to regulations, specifically decide the number of Deputy Heads of each professional department under the management scope.
Authorize the implementation of one or a number of tasks and powers under the authority of the People's Committee at the commune level according to the provisions of law; annually, report to the People's Council at the commune level (if any), the People's Committee at the provincial level on the organization and operation of the professional department.
Decree No. 370/2025/ND-CP takes effect from January 1, 2026.
