Proposal of authority of Hanoi City People's Council on organizational structure

According to the expected program, at the First Session, the 16th National Assembly will consider and pass the revised Capital Law.

This Law stipulates the position and role of the Capital; mechanisms, policies, authority, responsibility for building, developing and protecting the Capital.

Article 7 of this draft Law clearly states that the City People's Council (HĐND) decides and promulgates regulations on the proportion of full-time HĐND delegates; the number, functions, tasks and powers of the Boards of the City People's Council and the Commune-level People's Council; criteria for determining the number of Commune-level People's Council delegates;

At the same time, it stipulates the number and structure of members of the City People's Committee (UBND) and commune level; the organization and operation of villages and residential groups; the number, titles, title standards, regimes, and policies of non-specialized personnel in villages and residential groups in accordance with the level of urbanization and the actual conditions of socio-economic development of the City.

Regulations on the number, establishment, reorganization, dissolution of specialized agencies and administrative organizations under the City People's Committee, commune-level People's Committee; decisions to change the name and adjust the functions of existing specialized agencies and administrative organizations.

Regulations on the establishment of public non-business units under the City People's Committee, commune-level People's Committees, except for cases specified in Clause 3, Article 16 of this Law.

Regulations on autonomy for public non-business units under the management of the City; income policies for cadres, civil servants, public employees and employees receiving salaries from the City budget; the use of budget sources at all levels of the City and other legal financial sources to implement this policy.

Positions of civil servants and public employees under the management scope of the City; management and use regime of civil servants and public employees according to the principle that the person directly using civil servants and public employees implements recruitment and evaluation; pilot contract civil servant regime...

The draft revised Capital Law also clearly states that the City People's Committee has many powers.

In which, it has the authority to establish public non-business units according to the regulations of the City People's Council; regulations on policies and measures to organize the implementation of digital administration and digital public services.

Regulations on mechanisms and measures to promote democracy at the grassroots level, mobilize the participation of people in local governance; mechanisms for contracting work and other mechanisms to promote the self-management role of villages and residential groups.
