Government continues to temporarily suspend the application of Decree 46 on food safety
The Government continues to temporarily suspend the application of Decree 46 until the Law on Food Safety (amended) and the guiding Decree take effect.
The Government issued Resolution No. 15/2026/NQ-CP temporarily suspending the application of Decree No. 46/2026/ND-CP dated January 26, 2026 detailing the implementation of a number of articles and measures to organize and guide the implementation of the Law on Food Safety and Resolution No. 66/13/2026/NQ-CP dated January 27, 2026 regulating the announcement and registration of food products until the Law on Food Safety (amended) and the Decree guiding the Law on Food Safety (amended) take effect.
During the period of temporary suspension of validity of the above 2 documents, Decree No. 15/2018/ND-CP dated February 2, 2018 of the Government detailing the implementation of a number of articles of the Law on Food Safety and documents regulating and guiding implementation continue to be effective.
The Government requests the Ministries of Health, Industry and Trade, Agriculture and Environment to proactively guide the organization of implementation of this Resolution according to the assigned management areas.
Strengthen the implementation of plans to inspect, monitor, and supervise periodically and unexpectedly, supervise, guide, and handle violations of food safety in the process of production, export, import, and business of food, assigned tasks and assigned tasks under assigned management.
Proactively review, amend, supplement and promulgate legal documents, national technical regulations (QCVN), professional guidelines, and internal procedures under the assigned management scope in the field of food safety.
Proactively review the 2010 Food Safety Law to propose amendments and supplements according to functions and tasks to send to the Ministry of Health for synthesis and development of the Law on Food Safety (amended); participate in building the Law on Food Safety (amended), Decree guiding the Law on Food Safety (amended) and relevant guiding documents of the Law on Food Safety (amended).
The Government assigns the Ministry of Health to inspect, monitor, supervise, and handle violations of registration of product announcements and advertising for products, goods, and services in the assigned management field; production conditions for establishments that have been granted Certificates of eligibility for food safety meeting the Good Manufacturing Practices (GMP) requirements for health protection foods and establishments that meet good practices in producing medicinal herbs and traditional medicines participating in the production of health protection foods.
The Ministry of Industry and Trade shall inspect, review, monitor, supervise, and handle violations in food business activities, food being counterfeit goods, banned goods, smuggled goods and other acts of trade fraud related to food on e-commerce platforms, promptly detect and handle violations according to regulations.
Ministry of Culture, Sports and Tourism strengthens management of advertising activities.
Provincial and city People's Committees regularly propagate and disseminate legal documents, technical professional guidelines in the field of food safety to commune-level authorities, associations, businesses and related subjects to know and implement.
Strengthen the implementation of periodic inspection plans; conduct surprise inspections, monitor, supervise, guide, promptly detect and handle violations of food safety, food that is fake goods, banned goods, smuggled goods in the area and other acts of trade fraud related to food on e-commerce platforms according to regulations and assigned and decentralized tasks.
Pay attention to preventing food poisoning for street food, school kitchens and collective kitchens.
