Duties of civil enforcement agencies of provinces and cities

The National Assembly has passed the Law on Civil Judgment Enforcement. This Law takes effect from July 1, 2026.

The law stipulates that the civil judgment enforcement agency is the agency with the function of organizing the enforcement of judgments and decisions according to the provisions of this Law and relevant legal provisions.

Civil enforcement agencies have a Head and Deputy Head with legal status, seals with the image of the National emblem, headquarters and separate accounts. The head of the civil judgment enforcement agency is the head of the civil judgment enforcement agency.

The organizational structure of civil enforcement agencies of provinces and cities includes units such as: Department of Professional Affairs and Organization of Civil Judgment Enforcement; Regional Civil Judgment Enforcement Department; other department-level units.

The Minister of Justice shall prescribe the names, functions, tasks, powers and organizational structure of civil judgment enforcement agencies of provinces and cities. The Minister of National Defense shall prescribe the names, functions, tasks, powers and organizational structure of the military region-level enforcement agency.

The law also clearly stipulates the duties and powers of the civil enforcement agencies of provinces and cities.

Typically, there is the preparation of a dossier to propose consideration of exemption or reduction of civil judgment enforcement obligations; coordinate with competent authorities in preparing a dossier to propose consideration of amnesty, consideration of reduction of prison sentence implementation period for those who must serve sentences.

Management, direction, professional guidance, inspection, and urging the enforcement of civil judgments in provinces and cities; ensuring the unified application of legal regulations in civil judgment enforcement activities.

In addition, resolve complaints and denunciations about the enforcement of civil judgments under its authority according to the provisions of this Law.

At the same time, it helps the Provincial People's Committees fulfill their responsibilities, tasks, and powers in enforcing civil judgments according to the provisions of law.

Report to the People's Council and the Provincial People's Committee on the results of the implementation of civil judgments; the amendment, supplementation, explanation of judgments, decisions, and resolution of Court recommendations;

Report on coordination and other contents in civil judgment enforcement activities according to the provisions of law; report to the Court on the results of judgment enforcement and decide upon upon request.
