The Ministry of Justice has new functions and tasks

The Government has issued Decree 09/2026/ND-CP stipulating the functions, tasks, powers and organizational structure of the Ministry of Justice.

Supplementing the function of state management of administrative procedure control

Decree No. 09/2026/ND-CP clearly states that the Ministry of Justice is a Government agency, performing the function of state management of: Law making; law enforcement organization; civil judgment enforcement; judicial administration; judicial assistance; legal work; administrative procedure control (AP); state management of public career services in fields under the state management of the Ministry.

Thus, the Ministry of Justice is assigned additional functions in controlling administrative procedures.

The Ministry of Justice performs the tasks and powers prescribed by the Law on Government Organization, the Government's regulations on the functions, tasks, powers and organizational structure of the Ministry, ministerial-level agencies and 23 tasks and powers.

Regarding administrative procedures control, the Ministry of Justice is responsible for guiding, monitoring, urging, and inspecting the implementation of administrative procedures control work of ministries, branches, and provincial People's Committees; synthesizing the situation and implementation results, reporting to the Government and the Prime Minister.

Preside over the implementation of the task of reforming administrative procedures and the one-stop, one-stop mechanism in handling administrative procedures at state administrative agencies; communication work on administrative procedures reform.

organizational structure includes 20 units

The organizational structure of the Ministry of Justice consists of 20 units.

Of which, 16 units are administrative organizations that assist the Minister in performing the function of state management: Department of Work on drafting legal documents; Department of Organization and Personnel; Department of International Cooperation; Ministry Office; Department of Civil Judgment Enforcement Management; Department of Criminal - Administrative Law and Management of Administrative Violations; Department of Civil - Economic Law; Department of International Law and International Investment Dispute Resolution; Department of Document Inspection and Organization of Law Enforcement; Department of Public dissemination, Education and Legal Assistance; Department of Judicial Administration; Department of Registration of Transactions and State Compensation; Department of Judicial Assistance; Department of Control of administrative procedures; Department of Planning - Finance; Department of Information Technology; Department of Industrial Strategy; Department of Legal and Industrial Law Management; Department of Legal and Legal Journalism; Department of Legal and Administrative Journalism; Department of Public Administration of Law; Department of Public Administration of Law.

Regarding transitional provisions, the Decree also clearly states that the task of directing, monitoring, guiding professional and technical skills, inspecting redistribution; managing redistribution organizations and activities will continue to be implemented until the Law on Civil Judgment Enforcement No. 106/2025/QH15 takes effect.

The task of state management of judicial equivalent and the focal point for implementing judicial equivalent in civil matters will continue to be implemented until the Law on Legal equivalent in Civil matters No. 102/2025/QH15 takes effect.

The Department of Administrative Control performs the tasks and powers on administrative control prescribed in this Decree from the time of the decision of the Minister of Justice stipulating the functions, tasks, powers and organizational structure of the Department of Administrative Control taking effect.

Decree 09/2026/ND-CP takes effect from January 10, 2026.
