Part-time workers transferred to villages not subject to streamlining
The Ministry of Home Affairs guides the implementation of policies and regimes for part-time workers at the commune level who return to villages and residential groups upon leave.
The Ministry of Home Affairs has issued a document responding to the proposal of the Department of Home Affairs of Phu Tho province on asking for guidance on implementing regimes and policies for part-time workers at the commune level according to Decree No. 154/2025/ND-CP regulating staff streamlining.
When implementing the model of organizing local government at 2 levels according to the provisions of the Law on Organization of Local Government in 2025, there will be no longer the title of non-professional activist at the commune level.
On that basis, the Ministry of Home Affairs clarified that when the title of non-professional activist in a commune is terminated but the title of non-professional activist in a village or residential group is still held, they are not subject to resignation according to the provisions of Decree No. 154/2025/ND-CP.
The Ministry of Home Affairs cited a specific case, Mr. Nguyen Van A, from July 1, 2025, no longer holding the position of Vice Chairman of the Commune Farmers' Association but still holding the position of part-time worker in the village or residential group, is not identified as a subject of resignation to enjoy the streamlining regime according to Decree No. 154/2025/ND-CP.
The Ministry of Home Affairs also clarifies the case of non-professional workers at the commune level who are Vice Chairmen of the Commune-level Veterans Association and have enjoyed the regime and policies according to the provisions of Decree No. 150/2006/ND-CP detailing and guiding the implementation of a number of articles of the Veterans Ordinance (amended and supplemented in Decree No. 157/2016/ND-CP) and Circular No. 03/2020/TT-BLDDTBXH (instructions for implementing the regime and policies for veterans according to the provisions of Decree No. 157/2016/ND-CP), they are not subject to Decree No. 154/2025/ND-CP.
This guidance is the basis for other localities to review and handle similar cases, ensuring that the implementation of staff streamlining policies associated with organizational arrangement is strictly implemented, to the right subjects, to the right regimes, contributing to stabilizing the grassroots team in the process of restructuring the local government organization.
