Allowances for non-professional workers at the commune level until May 2026
The Ministry of Home Affairs has just issued instructions on allowances for part-time workers at the commune level when organizing local government at 2 levels.
The Ministry of Home Affairs has issued Official Letter 11185/BNV-VP guiding allowances and salary classification when organizing local government at 2 levels to the Department of Home Affairs of Khanh Hoa province.
According to the Department of Home Affairs of Khanh Hoa province, the regulations on the regime and policies for part-time workers at the commune level according to the Resolution of the Provincial People's Council are based on the contract level stipulated in Decree No. 33/2023.
This Department wonders, after arranging the commune-level administrative units, if we continue to employ non-specialized workers at the commune level, will the allowance levels of the new commune level be accumulated with the allowance levels of the previous communes, wards and towns arranged according to Decree No. 33/2023 to equally divide the allowance levels for non-specialized workers at the commune level being arranged?
For example: Commune A before the arrangement is a type I administrative unit allocated to the allowance fund at 21.0 times the basic salary corresponding to 14 people;
Commune B before being reorganized as a type II administrative unit is allocated an allowance fund equal to 18.0 times the basic salary corresponding to 12 people;
Commune C before the arrangement is a type III administrative unit with a controlling allowance fund equal to 15.0 times the basic salary corresponding to 10 people.
After the arrangement of communes A, B, C into a new commune, the total number of non-professional workers at the commune level who are temporarily assigned to perform tasks is 15 people.
Thus, can the allowance contract of the new commune be accumulated with the allowance contract of the 3 old communes (21.0+18.0+15.0) to be divided equally among the 15 people currently arranged (ie, each position actually arranged is entitled to 3.6 times the basic salary including social insurance contributions)?
If the accumulation is not achieved, the Department of Home Affairs of Khanh Hoa province will request the Ministry of Home Affairs to guide the allowance levels for these cases.
Regarding the above content, the Ministry of Home Affairs has responded in Official Letter 11185/BNV-VP.
According to the Ministry of Home Affairs, the Conclusions of the Politburo, the Secretariat, Document No. 12/CV-BCD dated June 20, 2025 of the Steering Committee for the arrangement of administrative units and the development of a model of organizing local government at 2 levels and Decree No. 154/2025 dated June 15, 2025 of the Government on streamlining the payroll have stipulated and provided specific instructions on temporarily arranging and resolving policies for non-professional workers at the commune level until May 31, 2026.
Accordingly, the allowance level for part-time workers at the commune level will continue to apply the allowance level prescribed in the Resolution of the People's Councils of provinces and cities before the arrangement or the People's Councils of provinces and cities after the arrangement can issue a Document to decide to apply the allowance level according to the Resolution of one of the Resolutions of the Provincial and Municipal People's Councils before the arrangement.
The Ministry of Home Affairs notes that it is not necessary to combine the allowance fund for each commune-level administrative unit into the allowance fund for the new commune-level administrative unit to serve as a basis for re-regulating the allowance level for each position.
