Ministry of Home Affairs answers how to calculate 5 years of service to receive civil servants into civil servants
The Ministry of Home Affairs specifies the 5-year working period condition for civil servants who are admitted to civil servant positions as specialists or equivalent.
Ms. Dao Thi Mai (name of the character changed) said that she is currently an official at the Commune General Service Center. On June 15, 2026, she was assigned to work at the Commune Culture and Social Affairs Department and was assigned to be in charge of accounting work of the department.
According to Ms. Mai, currently the Department of Culture and Society where she is assigned to work is still lacking 3 specialist positions, including the accounting position.
Ms. Mai said that she was recruited to work from December 15, 2011, recruitment code 06a. 032 - College Accountant, salary coefficient 2.10. By 2014, she had a university degree in accounting but the district had not had a promotion consideration.
By July 2024, she was transferred and ranked as Accountant 06.031, enjoying a salary coefficient of level 5 of 3.66 and receiving salary according to university level. Before July 2024, she received salary according to college level.
Currently, Ms. Mai wishes to be recruited as a civil servant in the accounting position at the Commune Culture - Social Department. She requested the competent authority to inform her whether her case is considered to meet the working time condition according to the corresponding points and clauses in Article 13 of Decree 170/2025/ND-CP, which has been amended and supplemented in Decree 300/2026/ND-CP, or not.
Ms. Mai also requested to clarify whether she must have had enough 5 years of salary according to university level to meet the conditions for receiving a civil servant.
Ms. Mai hopes to receive guidance from the Ministry of Home Affairs to have a basis for implementing according to the provisions of law.
Regarding Ms. Mai's reflection and recommendations, the Ministry of Home Affairs has responded at the Electronic Information Portal.
According to the provisions of point d, clause 2, Article 13 of Decree No. 170/2025/ND-CP dated June 30, 2025 of the Government regulating the recruitment, use and management of civil servants, amended and supplemented in point d, clause 2, Article 3 of Decree No. 300/2026/ND-CP dated July 29, 2026 of the Government amending and supplementing a number of articles of Decree No. 170/2025/ND-CP, if a public employee is recruited into a civil servant position in a job ranked as a specialist or equivalent, they must have 5 years or more of working experience in a job requiring university training and be ranked with a corresponding salary in the specialist or equivalent rank.
Based on the provisions of Article 67 and Article 68 of Decree No. 170/2025/ND-CP, amended and supplemented in Decree No. 300/2026/ND-CP dated July 29, 2026 of the Government, the Ministry of Home Affairs requests you to exchange with the civil servant management agency where you work for consideration and settlement according to regulations.
