Two businesses in Ho Chi Minh City sued for 28.45 billion VND for late social insurance payments
Two Ho Chi Minh City businesses are late in paying 28.45 billion VND of social insurance, being sued by the People's Procuracy of Region 4.
According to the plan, tomorrow morning (September 29, 2026), the People's Court of Region 4 of Ho Chi Minh City will conduct a first-instance trial of 2 cases regarding "Request to fulfill insurance payment obligations" initiated by the People's Procuracy of Region 4.
According to the case file, T&T Transport Construction Trading and Service Co., Ltd. (T&T Transport Construction Transport Company) has 71 employees. This enterprise has only fulfilled its social insurance obligations until October 2020 and as of August 31, 2026, it is still late in paying nearly 14.69 billion VND of social insurance.
Phong Phu Sac Viet Joint Stock Company (Phong Phu Sac Viet Company) has 69 new employees paying social insurance until September 2024 and by August 31, 2026, this company still has to pay nearly 13.76 billion VND.
Both of the above enterprises have been administratively sanctioned by the Ho Chi Minh City People's Committee for the act of late payment of social insurance. Although the social insurance agency has repeatedly urged, inspected, reminded and requested rectification, the two companies have not fully fulfilled their obligations.
The Ho Chi Minh City Labor Federation and Hoa Hung Grassroots Social Insurance have issued documents requesting the People's Procuracy of Region 4, Ho Chi Minh City to sue to protect public interests.
The People's Procuracy of Region 4, Ho Chi Minh City has sued the above two enterprises and requested the court to order the two enterprises to pay an amount of about 28.45 billion VND and pay a late payment interest rate of 0.03%/day calculated on the amount of late payment and the number of days of late payment from September 1, 2026 until the obligation is fulfilled.
This is the first time the People's Procuracy has sued a business for late payment of social insurance according to Resolution 205/2025/QH15 of the 15th National Assembly "On piloting the People's Procuracy to sue civil cases to protect the civil rights of vulnerable groups or protect public interests".
