Ministry of Home Affairs guides salary ranking for civil servants with 7 years and 9 months of social insurance contribution
The Ministry of Home Affairs guides the calculation of 7 years and 9 months of social insurance contributions to rank salaries when recruiting civil servants.
Mr. Truong Van Binh (name of the character changed) said that he has a total compulsory social insurance (BHXH) contribution period of 7 years and 9 months, and has not received a one-time social insurance allowance.
When submitting a civil servant recruitment application and signing a work contract at a public hospital from January 1, 2025, he did not have time to supplement a separate form showing the social insurance payment process for the recruitment council to use as a basis for calculating and ranking salary grades. Currently, he is ranked 1st grade salary with the title of IV grade nurse.
Mr. Binh requested the Ministry of Home Affairs to guide whether working time at private hospitals, with full compulsory social insurance contributions, is considered for calculation into working time to rank and raise salary grades for public employees or not?
He also requested specific guidance on legal bases, how to calculate working time and documents to be submitted to supplement dossiers.
Regarding Mr. Binh's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.
As of January 1, 2025, salary ranking when recruited as civil servants with working time and social insurance contributions is implemented according to the provisions of Circular No. 05/2024/TT-BNV dated June 27, 2024 of the Minister of Home Affairs stipulating standards and conditions for considering promotion to rank II and rank I for administrative civil servants, clerical civil servants, archival civil servants; salary ranking for people recruited and received as civil servants.
According to Circular No. 05/2024, based on the total time of receiving salary with compulsory social insurance contributions (if there is non-continuous time but there is no one-time social insurance benefit, it is accumulated) minus the probationary period calculated according to the regulations of the professional title appointed when recruiting and receiving, the remaining time is used as a basis for ranking salary in the professional title recruited and received as follows: Calculated from the grade 1 of the professional title of civil servant appointed when recruiting and receiving, after each period of 3 years (enough 36 months) for cases appointed to the title of civil servant ranked as type A0, type A1 or after each period of 2 years (enough 24 months) for cases appointed to the title of civil servant ranked as type B, it is ranked up to 1 salary grade.
After converting the time to be ranked into the salary grade in the professional title appointed when recruiting and receiving as mentioned above, if there are months that are not enough 36 months (for civil servants ranked as type A0, type A1) or not enough 24 months (for civil servants ranked as type B), these months are counted into the time for considering salary grade promotion next time or considering enjoying seniority allowance beyond the frame (if any) in the title appointed when recruiting and receiving.
Based on the provisions of Article 58, Article 59 and Article 60 of Decree No. 259/2026/ND-CP, the Ministry of Home Affairs requests you to exchange with the agency or unit managing public employees where you work for consideration and resolution.
