Reviewing and preventing transport businesses from avoiding paying social insurance for drivers

Ho Chi Minh City Social Insurance proposes to review compulsory insurance contributions at transport business units, in order to prevent the situation of evasion of obligations and protect the rights of workers.

Pressure to recover outstanding social insurance debts

The supervisory delegation of the Ho Chi Minh City Labor Federation (LĐLĐ) led by Mr. Phung Thai Quang, Vice Chairman of the City LĐLĐ, just had a working session with the City Social Insurance on the situation of management, revenue - expenditure and handling of social insurance, health insurance (BHYT), and unemployment insurance (BHTN) debts in the area in 2026.

Mr. Nguyen Quoc Thanh - Deputy Director of Ho Chi Minh City Social Insurance - said that as of September 30, the city has more than 4.69 million people participating in compulsory social insurance, more than 118,000 people participating in voluntary social insurance, 4.63 million people participating in unemployment insurance and more than 12.6 million people participating in health insurance. The Social Insurance Agency continues to strengthen revenue management, resolve regimes, and ensure the rights of participants.

The situation of late payment of social insurance in Ho Chi Minh City is still at a very high level. As of September 30, the amount of late payment of social insurance, health insurance, and unemployment insurance is nearly 13,600 billion VND, accounting for more than 8.4% compared to the revenue plan assigned by Vietnam Social Security. The total number of late payment units recorded is 158,273 units.

The situation of enterprises delaying social insurance and health insurance payments for a long time directly affects the confirmation of participation time and settlement of benefits for employees. Ho Chi Minh City Social Insurance determines debt recovery as a key task, requiring units to review and classify enterprises according to the level, cause and recovery capacity to have appropriate handling measures.

Reviewing the implementation of social insurance and health insurance obligations in the transport sector

One of the notable contents at the working session was the proposal to review the implementation of social insurance contribution obligations for employees in the transport business sector. The City Social Insurance Agency requested the City Labor Federation to consider, summarize and propose to the City People's Committee to direct relevant departments and branches to coordinate in reviewing and managing employees subject to compulsory insurance in areas with specific labor use.

According to Mr. Nguyen Quoc Thanh, for the transport sector, Ho Chi Minh City has 6,787 transport business units, including cooperatives, companies and transport business households, which are being granted valid transport business licenses. The total number of vehicles granted badges is up to 324,473 units. The large scale of the transport sector poses stricter management requirements for labor use and implementation of social insurance and health insurance policies.

From this basis, the City Social Insurance proposed that the City Labor Federation propose to the City People's Committee to direct the Department of Construction to coordinate with the Social Insurance agency to review transport business units, inspect the conclusion of labor contracts and the implementation of social insurance and health insurance obligations for drivers and service staff on vehicles subject to compulsory participation.

In particular, the social insurance agency requests to promptly detect the use of cooperation contracts, service contracts or other forms of agreements that are not consistent with the nature of labor relations in order to evade social insurance and health insurance contribution obligations.

At the same time, study the mechanism for periodically providing and exchanging information about transport business units and vehicles granted badges to serve management and review of participants.

Regarding the issue of contracts and social insurance for drivers, a representative of a transport business headquartered in East Ho Chi Minh City said that all drivers of the unit have signed contracts and participated in social insurance and health insurance in accordance with regulations before participating in passenger transport activities.

This unit currently operates in 3 forms of transportation including fixed routes, contracts and buses, with a scale of more than 1,000 drivers operating in Ho Chi Minh City and many localities, always ensuring compliance with policies for employees.

For drivers working at the company, it is mandatory to fully participate in the regime according to regulations. If not implemented, when an incident occurs during operation, functional agencies can easily check whether the unit does not comply with regulations for employees. At that time, the enterprise will be penalized, seriously affecting its reputation and brand," the unit representative emphasized.

The enterprise does not accept the request to receive cash instead of paying insurance from the elderly driver; and at the same time refuses to use labor that does not agree to participate in insurance according to regulations.
