Ho Chi Minh City proposes businesses to participate in supporting administrative procedures
Ho Chi Minh City proposes socializing many stages to support the resolution of administrative procedures, from receiving and digitizing dossiers to returning results.
The Office of the Ho Chi Minh City People's Committee is seeking opinions on the draft Resolution of the City People's Council stipulating the mechanism for socializing professional and nghiệp vụ activities to support the resolution of administrative procedures.
According to the draft, support service providers can be public non-business units, enterprises or legally established organizations.
The draft proposes 6 groups of professional and nghiệp vụ activities to be allowed to socialize.
In which, organizations can participate in supporting people to declare information, create electronic dossiers, receive, review, classify and check the completeness and validity of dossiers according to procedures issued by state agencies.
In addition, units are also allowed to digitize dossiers, enter data, update, standardize and synchronize data; support comparison, verification of information, collection and analysis of dossiers, conditions appraisal according to regulations; monitor the progress of processing and storing dossiers, support result return and operation of the Public Administrative Service Center, One-Stop Shop Department.
Organizations can also support people in implementing online public services, electronic payments, electronic authentication, using digital signatures and digital platforms in the process of resolving administrative procedures.
The draft emphasizes that service providers are only allowed to perform tasks within the scope assigned, ordered or contracted by state agencies.
Activities that exercise state power such as licensing, approving, certifying or issuing administrative decisions are still under the authority of state agencies.
Service providers must be responsible before the law and competent authorities for service quality, implementation progress, information security and compensation for damages if errors occur due to their fault.
The draft allows state agencies to select service providers through many forms such as assigning tasks, placing orders, bidding, direct appointment of contractors, cooperation agreements or other mechanisms as prescribed by law.
One of the notable points of the draft is affirming that the use of support services is entirely on a voluntary basis.
People and businesses have the right to choose or not choose to use administrative procedure support services. Not using services will not affect the right to submit dossiers, the right to resolve administrative procedures as well as other legitimate rights and interests as prescribed.
For services that people voluntarily use, the cost will be paid directly to the supplier according to the price approved by the Ho Chi Minh City People's Committee and publicly listed. In case the service is covered by state funding or has support policies, the budget will be paid to the supplier according to regulations.
To attract organizations to participate in providing services, the draft proposes many preferential mechanisms such as supporting investment costs for technology infrastructure, equipment, software, human resources and other reasonable costs; prioritizing site allocation at the Public Administration Service Center, One-Stop Shop Department; training and fostering personnel and supporting digital transformation.
