Improving the quality of investigation, prosecution, trial and judgment enforcement

On July 27, the National Assembly Standing Committee gave opinions on the draft Resolution of the National Assembly replacing Resolution No. 96/2019/QH14 on crime prevention and combat and law violations, the work of the People's Procuracy, the People's Court and judgment enforcement.

Deputy Chairman of the Law and Justice Committee Nguyen Thi Thuy said that the development of the Resolution project aims to fully and correctly institutionalize the Party's guidelines and policies, especially the Resolution of the 14th Party Congress.

At the same time, contributing to improving the quality and effectiveness of crime prevention and combat, law violations, investigation, prosecution, trial, and judgment enforcement; sustainable reduction of crimes; maintaining political security, social order and safety, creating a stable environment to promote socio-economic development, serving the goal of double-digit growth.

The development of the Resolution must create a basis for the National Assembly to accurately and objectively assess the results of crime prevention and combat and law violations, investigation, prosecution, trial, and judgment enforcement.

Expressing the preliminary thẩm tra viewpoint of the Resolution project, Deputy Chairman of the Law and Justice Committee Mai Thi Phuong Hoa said that the Standing Committee of the Committee and the Standing Committees of the National Assembly agencies agreed with the necessity of issuing the Resolution; basically agreed with the guiding viewpoint and scope of regulation of the draft Resolution.

It is proposed that the Drafting Committee continue to review to ensure consistency with relevant laws and draft codes and laws being amended such as the Penal Code, the Criminal Procedure Code, the Law on Organization of Criminal Investigation Agencies, the Law on Handling of Administrative Violations... ; continue to review to ensure compatibility with international treaties to which Vietnam is a member.

Speaking in conclusion, Member of the Party Central Committee, Vice Chairman of the National Assembly Nguyen Khac Dinh emphasized that the National Assembly Standing Committee agreed with the viewpoints of comprehensively amending the Resolution, contributing to improving the operational efficiency of functional agencies, procuracy agencies, investigative agencies, and court agencies, meeting the very high requirements of innovation in thinking in law-making and judicial reform in the new period.

In which, the general viewpoint is that the Resolution is comprehensively amended but does not lower quality indicators compared to Resolution No. 96/2019/QH14; at the same time, it must also reflect tasks according to qualitative and quantitative indicators.

For quantitative targets, they must be specific, prove feasibility, and not chase after achievement diseases. At the same time, it is possible to decentralize to sectors, heads of sectors to specifically determine qualitative targets annually depending on the conditions and requirements of work activities, striving to do better and more quality work in the following year compared to the previous year and send targets to the National Assembly Standing Committee and the National Assembly for supervision.

The Vice Chairman of the National Assembly assigned the Drafting Committee to fully absorb the opinions at the meeting, the thẩm tra opinions of the Law and Justice Committee and the opinions of participating agencies to contribute opinions to complete the dossier of the Resolution project; assigned the Law and Justice Committee to organize the official thẩm tra of the Resolution project to submit to the National Assembly at the First Extraordinary Session.
