New proposal on civil servant payroll at provincial and commune levels
The Ministry of Home Affairs proposes that civil servant payroll be determined based on job positions, workload and many factors.
The Ministry of Justice is appraising the draft Decree on management and use of civil servant payroll, which is being developed under the Ministry of Home Affairs' chairmanship.
In the draft Decree, the Ministry of Home Affairs proposes regulations on the basis for determining civil servant payroll. Accordingly, civil servant payroll is built on the job position and workload of each civil servant job position according to the functions, tasks, powers and organizational structure of the administrative organization.
Improving processes, changing operating methods, working regulations; the level of modernization of equipment and working facilities, application of information technology, reform and simplification of administrative procedures, digital transformation; decentralization and delegation of power are also factors affecting the number of civil servants.
Civil servant payroll is also built on the actual management and use of assigned civil servant payroll; the signing of contracts for some tasks of civil servants according to the provisions of Article 21 of the Law on Cadres and Civil Servants.
For administrative organizations at the provincial and commune levels, the determination of this staff size needs to be based on the number, classification of commune-level administrative units, population, area, level of socio-economic development and specific factors.
The draft decree also clearly states the authority to decide on the assignment of civil servant payroll of ministries and localities.
According to the draft, based on the number of civil servant payrolls for 5 years, annually assigned by competent authorities, the Minister of Home Affairs decides to assign civil servant payrolls to each ministry before October 1st of the year immediately preceding the plan year or plan period.
Based on the 5-year civil servant payroll, annually assigned by the Minister of Home Affairs, the head of the Ministry decides to assign annual civil servant payroll for each agency using civil servant payroll within its management scope before October 31 of the year immediately preceding the planned year.
And at the local level, the Provincial People's Committee develops a plan to allocate annual civil servant payroll for agencies using civil servant payroll at the provincial and commune levels.
The Provincial People's Committee submits to the Provincial People's Council a decision to allocate annual civil servant payroll in the Boards of the Provincial People's Council, administrative organizations under the Provincial People's Committee, Boards of the Commune People's Council and administrative organizations under the Commune People's Committee within the annual civil servant payroll assigned by competent authorities before October 1, the year immediately preceding the planned year.
Regarding the regulation on assigning civil servant payroll of representative agencies, the Ministry of Home Affairs proposes that based on the 5-year, annual civil servant payroll of the representative agency assigned by competent authorities, the Minister of Foreign Affairs issue a decision to assign annual civil servant payroll of the representative agency to each ministry before October 1, the year immediately preceding the planned year.
On that basis, the head of the ministry decides to assign annual civil servant payroll for representative agencies under management before October 31 of the year immediately preceding the planned year.
Every year, the head of the ministry decides to assign and adjust civil servant payroll for each representative agency under its management.
