Prolonged social insurance debt, the company is verified by the Procuracy

This is a move to immediately start verifying, after the unit and Ham Thang Social Insurance agency signed a coordination plan to implement policies and laws on insurance on October 29. Through this, the two sides strengthen information exchange, review, urge units that are late in paying and evading social insurance and coordinate to verify and handle cases with signs of violations according to regulations.

At a working session with the Procuracy at the end of October, representatives of employees of Thanh Nguyen Co., Ltd. presented the developments of being late in paying insurance by the company for a long time, the process of sending complaints and requested functional agencies to support the settlement.

Employees also provided relevant documents and salary slips showing that the company deducted 10.5% of salary to pay social insurance, but the insurance was still owed for a long time.

Notably, employees provide the Procuracy with information about cases of employees who are pregnant, employees raising children under 36 months old affected by the situation of late payment and evasion of insurance by enterprises.

Previously, the employee representative sent a petition to the People's Procuracy of Region 12, requesting consideration and recommending initiating a civil case to request the company to fulfill its obligation to pay insurance, protect the rights of employees and public interests according to Resolution 205/2025/QH15.

On October 16, the Head of the People's Procuracy of Region 12 replied to the petition and said that Lam Dong does not belong to the 6 provinces and cities piloted for the Procuracy to initiate civil and public interest cases according to this resolution. Therefore, the unit does not have the authority to propose or initiate lawsuits under the pilot mechanism. However, the Procuracy still receives, inspects, verifies, collects documents, evidence and proposes remedies for violations if any according to its authority.

Lao Dong Newspaper has many articles reflecting the fact that Thanh Nguyen Co., Ltd. has owed social insurance from 2019 to now, affecting the social security rights of many workers, including pregnant women.

Director of Lam Dong Provincial Social Insurance Dang Hong Tuan informed that the unit has repeatedly requested the enterprise to rectify. Most recently, on October 8, the company paid 175 million VND to the social insurance agency and said that it would pay insurance for September 2026. In a report sent to the social insurance agency, the enterprise said that it will pay monthly insurance from September 2026 onwards; the old debt will be remedied by gradually paying in several installments. After the above payment, this company still owes more than 13.7 billion VND in social insurance, health insurance, and unemployment insurance.

Also according to Mr. Tuan, if the company continues not to rectify, the social insurance agency will strengthen inspection and administrative sanctions according to Decree No. 283/2026/ND-CP on sanctioning administrative violations in the field of labor and social insurance, effective from September 10th. After sanctioning, if the company still does not rectify, the file will be transferred to the Investigation Police Agency.
