According to Article 3, Decree No. 321/2026/ND-CP of the Government (effective from October 1, 2026) stipulates:

1. The standard level of preferential allowance for people with meritorious services to the revolution is 3,012,000 VND (hereinafter referred to as the standard level).

2. The standard level specified in Clause 1 of this Article serves as the basis for calculating the level of allowances, subsidies and preferential regimes for people with meritorious services to the revolution and relatives of people with meritorious services to the revolution. The levels specified according to the standard level in this Decree are adjusted when the standard level is adjusted and rounded up to thousands of VND.

Article 4, Decree No. 321/2026/ND-CP of the Government stipulates the level of enjoyment of preferential allowances and subsidies:

1. The level of monthly allowances and preferential allowances for people with meritorious services to the revolution and relatives of people with meritorious services to the revolution is specified in Appendix I issued together with this Decree.

2. The monthly preferential allowance level for war invalids and people enjoying policies like war invalids is specified in Appendix II issued together with this Decree.

3. The monthly preferential allowance level for type B wounded soldiers is specified in Appendix III issued together with this Decree.

4. The level of one-time preferential allowance for people with meritorious services to the revolution and relatives of people with meritorious services to the revolution is specified in Appendix IV issued together with this Decree. In case the one-time allowance level is calculated based on seniority, after the number of years of participating in the resistance war, participating in the war to protect the country or performing international duties has been rounded, if there are still odd months, the number of odd months is rounded according to the principle: from 06 months to less than 12 months is calculated as 01 year, less than 06 months is calculated as 06 months. In case the date and month of starting resistance activities cannot be determined, it is calculated from July 1 of that year.

If they find that the amount paid is lower than the level applied to their case, the person with meritorious services or relatives should prepare a decision to enjoy the regime, documents confirming the beneficiary and payment documents, then send a written request for inspection to the agency managing the dossier or the competent authority to resolve the regime in the locality.

The content of the request needs to clearly state the level being received, the level considered to be enjoyed, the time of difference, and the request to check the application of Decree No. 321/2026/ND-CP. If errors are detected, beneficiaries may request adjustments to the benefit level and resolve the remaining amount of money according to the regulations applicable to specific cases.

In case of disagreement with an administrative decision or administrative act related to the settlement of regimes, people with meritorious services may exercise the right to complain according to Article 7, Law on Complaints No. 02/2011/QH13 (on complaint procedures) amended and supplemented at point a, clause 2, Article 2, Law No. 136/2025/QH15, effective from July 1, 2026.

Thus, from October 1, 2026, people with meritorious services to the revolution but whose monthly allowance level is lower than the level specified in Decree 321/2026/ND-CP will follow the above procedure to receive the remaining amount.
