Clearly define the authority of the Chairman of Hanoi City People's Committee

On April 15, the National Assembly Standing Committee gave opinions on the explanation, reception, and revision of the draft Capital Law (amended).

In a summary report on the explanation, reception, and revision of the draft Capital Law (amended), Deputy Minister of Justice Nguyen Thanh Tu said that the draft Law was reviewed to ensure constitutionality, not contrary to international commitments and treaties.

The draft Law also clearly defines the authority of the city government in the direction of: The City People's Council decides on mechanisms, policies, and major issues; The City People's Committee stipulates the order and procedures for implementation; The Chairman of the City People's Committee stipulates the coordination and implementation measures in direction and administration between specialized agencies.

In addition, supplement and amend regulations to ensure comprehensive and thorough decentralization and delegation of power in parallel with power control.

The draft Law also stipulates that the pilot time of mechanisms and policies is no more than 5 years; allowing temporary suspension of the pilot when negative impacts exceed the forecast level.

At the same time, supplement "other mechanisms and policies as directed by competent authorities" into the pilot scope to ensure comprehensiveness.

On behalf of the thẩm tra agency, Chairman of the Law and Justice Committee Phan Chi Hieu affirmed that the Standing Committee basically agreed with the major orientations as well as many contents of explanation, reception, and revision of the draft Law, requesting agencies to continue to study to receive and revise some contents.

In which, it is proposed to continue reviewing the provisions of the draft Law to ensure the full institutionalization of the requirements on "increasing the authority of Chairmen of People's Committees at all levels" and the principle of clearly defining the authority between the People's Council, People's Committee, and Chairman of the People's Committee issued in Resolution No. 02-NQ/TW.

Contributing opinions at the meeting, Vice Chairman of the National Assembly Nguyen Khac Dinh requested the Government to clarify the contents proposed by the Standing Committee of the Law and Justice Committee in the Summary Report of opinions on explaining, receiving, and revising the draft Capital Law (amended).

In which, clearly defining the authority of the People's Council, People's Committee, and Chairman of the People's Committee is put forward in Resolution No. 02-NQ/TW.

Along with that, the content of exemption from legal liability in the pilot resolution of the City People's Council is not stipulated because it is directly related to administrative, civil, and criminal liability, but must be stipulated in the law.

Referring to the role of the Hanoi City People's Council, Chairman of the Economic and Finance Committee Phan Van Mai stated his opinion that the Hanoi City People's Council should be entitled to issue new regulations, suitable to reality when the law has not yet stipulated or is not clear, in order to contribute to promoting the development of Hanoi City.

Concluding this content, Vice Chairman of the National Assembly Nguyen Khac Dinh proposed to review, study, and absorb to the maximum extent the reasonable opinions in the Report of the Standing Committee of the Law and Justice Committee.

Synchronize the content of explanation and reception in the report submitted to National Assembly deputies with the content amended and completed in the draft Law. Urgently complete the draft Law with the highest quality to submit to the National Assembly for consideration and approval in the 2nd session of the 1st Session, 16th National Assembly.
