Article 9 of Decree 384/2026/ND-CP stipulates the determination of Vietnamese origin for goods manufactured and circulated domestically (effective from January 1, 2027) stipulates the responsibilities of traders, organizations, and individuals showing Vietnamese origin as follows:
1. Traders, organizations, and individuals who show Vietnamese origin on goods labels or on documents and items containing information related to goods are responsible for complying with the provisions of this Decree. For goods identified as Vietnamese origin by traders, organizations, and individuals, traders, organizations, and individuals are responsible for complying with legal regulations on goods labeling, protecting consumer rights, product and goods quality, and other relevant legal regulations.
2. Traders, organizations, and individuals showing their Vietnamese origin are responsible before the law for the accuracy and truthfulness of the published information; carry out the storage of dossiers and documents proving the origin of goods (including input invoices, inventory of raw materials, production process descriptions and other related documents) to serve the inspection and examination work of competent authorities. The storage in the form of electronic data and documents is carried out in accordance with the provisions of the law on accounting and the law on storage.
3. Traders, organizations, and individuals are responsible for proving that goods are of Vietnamese origin as prescribed in this Decree when requested by competent authorities.
4. Traders, organizations, and individuals are responsible for complying with Vietnamese law on the origin of exported goods and importing country regulations for goods manufactured and circulated domestically and then exported.
Thus, from January 1, 2027, traders have the same responsibility as above when showing goods of Vietnamese origin.
