Authority to regulate allowances for non-specialized workers in villages

Mr. Nguyen Van Huynh (name of the character changed) reflected on the arising problems related to the application of regulations on compulsory social insurance (BHXH) contributions for Village Heads and non-specialized operating titles (HĐKCT) in the village.

According to the proposed content, the phrase "monthly allowance level including social insurance contribution support" stipulated in Resolution No. 45/2026/NQ-HDND is currently understood and applied in different ways.

The lack of a unified understanding, according to reflections, may lead to differences in the process of organization and implementation, affecting the determination of social insurance contribution responsibilities and rights and obligations of voters in the village.

Therefore, Mr. Huynh requested competent authorities to guide and explain to unify the application of the provisions of the Law on Social Insurance.

Regarding Mr. Huynh's reflection and recommendation, the Ministry of Home Affairs has responded on the Electronic Information Portal.

The Ministry of Home Affairs cited Clause 1 and Clause 2, Article 15 of Decree No. 185/2026/ND-CP dated May 26, 2026 of the Government, stipulating that the state budget contracts allowance funds, including support for social insurance contributions to pay monthly allowances for people with HĐKCT in villages and residential groups.

Accordingly, for villages with 700 or more households; residential groups with 1,000 or more households; villages and residential groups belonging to key commune-level administrative units on national defense according to decisions of competent authorities; villages and residential groups belonging to commune-level administrative units in border and island areas or particularly difficult villages, the allowance fund is contracted at 8 times the base salary level.

For villages and residential groups that do not fall into the above cases, the allowance fund is contracted at 6.5 times the base salary.

Based on the allowance fund contracted by the state budget for each village and residential group; the balancing capacity of the local budget; relevant legal regulations and the specific characteristics of the locality, the Provincial People's Committee submits to the People's Council of the same level to specifically stipulate the allowance level for each position of voters in villages and residential groups.

In addition, Clause 2, Article 18 of Decree No. 185/2026/ND-CP stipulates that the Provincial People's Committee decides according to its authority or submits to the People's Council of the same level to decide on contents related to the organization and operation of villages and residential groups and regimes and policies for voters in villages and residential groups, and people participating in activities in villages and residential groups according to the provisions of the decree.

From the above regulations, the Ministry of Home Affairs said that the authority to specifically regulate regimes and policies for voters in villages and residential groups belongs to the Provincial People's Council.

According to the Ministry of Home Affairs, the content of Mr. Huynh's petition relates to the implementation of policies for voter registration in villages and residential groups in Quang Ngai province according to Resolution No. 45/2026/NQ-HDND of Quang Ngai Provincial People's Council.

Therefore, the Ministry of Home Affairs requests him to contact competent authorities in the locality for guidance and answers according to their authority.
