Trial of two businesses for late social insurance payments of nearly 28.5 billion VND in Ho Chi Minh City

On the morning of September 29, the People's Court of Region 4 held a first-instance trial of a labor case regarding the "Request to fulfill the obligation to pay insurance money". The case was initiated by the People's Procuracy of Region 4 against T&T Transport Construction Service Trading Co., Ltd. for late payment of insurance types of 71 employees with the amount of 14.69 billion VND and Phong Phu Sac Viet Joint Stock Company for late payment of 13.76 billion VND (partially remedied 400 million VND) for 69 employees.

In addition to the above amount, the People's Procuracy also requested the court to order the two enterprises to pay a late payment interest rate of 0.03%/day calculated on the late payment amount and the number of days late payment from September 1, 2026 until the obligation is fulfilled.

It is noteworthy that both of the above enterprises have been administratively sanctioned by the Ho Chi Minh City People's Committee for the act of late payment of social insurance. Although the social insurance agency has repeatedly urged, inspected, reminded and requested rectification, the two companies have not fully fulfilled their obligations.

The Ho Chi Minh City Labor Federation and Hoa Hung Grassroots Social Insurance have issued documents requesting the People's Procuracy of Region 4, Ho Chi Minh City to sue to protect public interests.

Talking to a reporter of Lao Dong Newspaper, Mr. Phung Thai Quang - Vice Chairman of the Ho Chi Minh City Labor Federation - emphasized that the fact that businesses are late in paying various types of insurance for employees has directly affected the rights of employees and social security policies in general.

The People's Procuracy's lawsuit against businesses for late social insurance contributions is a practical action to effectively implement Resolution 205/2025/QH15 of the 15th National Assembly "On piloting the People's Procuracy to sue civil cases to protect the civil rights of vulnerable groups or protect public interests", thereby contributing to protecting the legitimate rights and interests of employees.

The Ho Chi Minh City Trade Union organization will accompany functional agencies in the process of initiating lawsuits as well as requesting judgment enforcement, so that the law must be strictly implemented, not allowing the rights of employees to be damaged due to the delay and evasion of responsibility by businesses," Mr. Quang said.

Ho Chi Minh City Social Insurance said that as of September 20, 2026, this agency has coordinated with regional People's Procuracies to invite 7,916 units that are late in paying social insurance to work and there are 2,002 units participating, with a total remedial amount of 445 billion VND; there are 2,273 units remediating the amount of late payment of social insurance immediately after receiving the invitation letter.

The Ho Chi Minh City Social Insurance Agency has sent 34 official letters/documents requesting to sue units that are late in paying social insurance, and so far has provided 13/34 dossiers as requested by the Ho Chi Minh City People's Procuracy.
