Workers need to proactively check their social insurance participation process
Ho Chi Minh City Social Insurance recommends that employees should proactively check their social insurance participation process to avoid affecting their rights.
Over the past time, the situation of businesses delaying and evading social insurance contributions has been quite common, although functional agencies have drastically intervened to urge, remind, sanction or sue.
The question is, in case businesses are late in paying or evading social insurance, will the rights of employees (employees) be lost, such as maternity benefits or sick leave benefits?
Ho Chi Minh City Social Insurance said that businesses' late payment and evasion of social insurance payments may directly affect the settlement of social insurance benefits for employees, especially sickness, maternity, pension and benefits related to the social insurance participation process.
According to the provisions of law, employees are only considered for settlement of social insurance benefits for the time they have paid and meet the conditions for enjoyment. As for the time the enterprise has not paid or paid in full, the settlement of benefits may be affected. Also according to the provisions of law, employers are responsible for paying compulsory social insurance and compensation according to regulations if they do not perform or do not fully perform the responsibility of payment but cause damage to the legitimate rights and interests of employees.

Another reality is that many employees are still deducted monthly salaries by businesses to pay social insurance, but they do not know if the business has paid social insurance or not. Ho Chi Minh City Social Insurance recommends that employees should proactively check their social insurance participation process, not just based on the fact that the business deducts monthly salaries to assume that they have paid social insurance fully.
According to Ho Chi Minh City Social Insurance, employees can look up social insurance contribution information through the VssID application - digital social insurance, the participation process will show the enterprise's late payment period (if any) or contact the social insurance agency directly for support. When detecting that the enterprise is late in paying, paying incompletely or not paying social insurance, employees need to request the enterprise to explain and rectify, and can also report to the social insurance agency, trade union organization or competent authority to be protected in accordance with regulations or complain in accordance with the law.
Ho Chi Minh City Social Insurance recommends that employees need to proactively protect their social security rights by regularly monitoring the process of paying social insurance, health insurance, and unemployment insurance, comparing information with salaries and monthly deductible insurance premiums.

In particular, employees need to keep labor contracts, payrolls, and related deductible documents and promptly reflect when detecting that a business shows signs of violating social insurance obligations, and should not wait until they quit their jobs or have a need to enjoy benefits to check the social insurance participation process. Because early detection will help functional agencies promptly inspect and handle, limiting the impact on the rights of employees," Ho Chi Minh City Social Insurance emphasized.
