Is it possible to participate in security protection at the grassroots level when resigning under Decree 178?

Article 13 of the Law on Forces participating in protecting security and order at the grassroots level stipulates that Vietnamese citizens who wish and have the following standards and conditions are considered and selected to participate in the force participating in protecting security and order at the grassroots level:

1. From 18 years old to 70 years old; in cases over 70 years old and ensuring health, the Chairman of the Commune-level People's Committee shall consider and decide based on the proposal of the Commune-level Police;

2. Having a clear background; good moral qualities; themselves and their families well comply with the Party's guidelines and policies, and the State's policies and laws; not being a person being prosecuted for criminal liability, serving a criminal sentence in a commune, ward, or town, serving judicial measures or serving administrative handling measures. In case they have completed the judgment of the Court, they must have their criminal record expunged; if they have completed the decision to apply administrative handling measures, they must have expired the period considered not yet subject to administrative handling measures according to the provisions of law;

3. Having a diploma or completing a secondary education program or higher. For border areas, islands, mountainous areas, areas with particularly difficult socio-economic conditions, and ethnic minority areas, people who have completed primary education can be selected;

4. Being permanently or temporarily residing for 01 year or more and regularly living in the place where citizens submit applications to participate in forces participating in protecting security and order at the grassroots level. In cases specified in Clause 3, Article 15 of this Law, they must be permanently or temporarily residing at the place of application to participate in forces participating in protecting security and order at the grassroots level;

5. Have sufficient health according to the certificate of the medical examination and treatment facility established and operating in accordance with the law.

Thus, if you meet the above conditions, you may be considered for recruitment into the force participating in protecting security and order at the grassroots level.

Decree 178/2024/ND-CP does not stipulate that people who quit their jobs according to this decree but are accepted into agencies and units receiving salaries from the budget must return the received money.
