Contract workers in public non-business units in Ho Chi Minh City enjoy increased income
Reader hienhoaxxx@gmail. com asks: Are contract workers in public non-business units in Ho Chi Minh City entitled to additional income?
Legal Consulting Department of Lao Dong Newspaper answers:
Employees who sign contracts to do professional and nghiệp vụ work at public non-business units in Ho Chi Minh City may be subject to classification regulations as a basis for spending additional income. However, this amount of money is not used from the city budget.
Clause 1, Article 12, Regulations issued with Decision No. 78/2026/QD-UBND of the Ho Chi Minh City People's Committee clearly states that for people who are signed labor contracts to do professional and nghiệp vụ work in positions held by public employees according to the human resource needs of public non-business units and other subjects, agencies and units are applied this regulation to implement conversion as a basis for spending additional income.
Thus, contract workers belonging to the above group can be evaluated and converted to a classification level for consideration and payment. However, the regulation does not mean that all contract workers in public non-business units are naturally entitled to this amount of money.
According to Article 5 of the Regulation, quarterly evaluation results are converted into 4 levels: from 90 points or more is Level 1; from 85 to below 90 points is Level 2; from 70 to below 85 points is Level 3; below 70 points is Level 4.
Article 6 stipulates the corresponding benefit level: Level 1 is entitled to 100% of the additional income expenditure according to regulations; Level 2 is entitled to 90%; Level 3 is entitled to 80%; Level 4 is not entitled.
For example: If the level of additional income expenditure according to regulations applied to employees in one quarter is 10 million VND, the person ranked at Level 1 will receive 10 million VND; Level 2 will receive 9 million VND; Level 3 will receive 8 million VND. This is a hypothetical example to illustrate the calculation method, not a common expenditure level applied to all employees.
Regarding funding sources, Clause 2, Article 12, stipulates that additional income for the above-mentioned group of contract workers is paid from the financial resources of agencies and units according to legal regulations, without using the Ho Chi Minh City budget.
Therefore, employees need to determine whether they belong to the group to which the unit applies the regulations or not, and at the same time learn about the evaluation regulations, spending levels and funding sources of the unit. These are important bases to determine actual benefits.
Decision No. 78/2026/QD-UBND of the Ho Chi Minh City People's Committee takes effect from October 9, 2026. Abolishing Decision No. 19/2025/QD-UBND dated August 10, 2025 of the Ho Chi Minh City People's Committee on promulgating Regulations on evaluating and ranking quality according to work efficiency for cadres, civil servants, public employees, and employees at agencies and units in the City.
