Who is entitled to staff streamlining benefits when converting a non-business unit into a business

Article 39, Decree 373/2026/ND-CP stipulating the conversion of public non-business units into enterprises (effective from September 30, 2026) stipulates policies for redundant workers as follows:

1. For management officials, professional and nghiệp vụ officials, and people working under indefinite-term labor contracts who are working at the time of unit value determination and cannot be arranged jobs at the Joint Stock Company in the labor use plan, they are entitled to staff streamlining policies according to the Government's regulations.

2. For people working under fixed-term labor contracts who are working at the time of unit value determination and cannot be arranged for work at the Joint Stock Company in the labor use plan, they are entitled to policies according to the provisions of the labor contract.

Thus, from September 30, 2026, depending on the type of labor contract, redundant employees when transferring public non-business units to enterprises will enjoy different policies.
