Proposal to maintain the model of land fund development center under the Provincial People's Committee
The Ministry of Home Affairs responds to the proposal to maintain the model of land fund development center under the Provincial People's Committee.
Ha Tinh province proposed that the Ministry of Home Affairs propose to the Government to consider maintaining the model of provincial land fund development centers directly under the Provincial People's Committee, not implementing arrangement of public non-business units (DVSNCL) directly under departments and branches.
Regarding the above content, the Ministry of Home Affairs said: Based on the provisions of Decree No. 35/2025/ND-CP, the Ministry of Agriculture and Environment is responsible for managing, guiding, and directing the implementation, and managing the organizational structure for industries and fields under its management, including state management of land.
Currently, according to the assigned tasks, the Ministry of Agriculture and Environment is presiding over and coordinating with ministries, branches, localities and relevant agencies to develop and propose amendments and supplements to a number of articles of the 2025 Land Law to submit to competent authorities according to regulations.
Therefore, the Ministry of Home Affairs requests localities to have opinions with the Ministry of Agriculture and Environment in the process of amending and supplementing the above-mentioned Land Law (during the time before promulgating the Law amending and supplementing a number of articles of the Land Law, the arrangement and consolidation of the Land Fund Development Center and the Land Registration Office shall be implemented in accordance with the provisions of the 2025 Land Law and guiding documents for implementation).
Within the scope of assigned functions and tasks, the Ministry of Home Affairs will record voters' opinions and will study, participate, and coordinate with the Ministry of Agriculture and Environment on this content when requested.
Regarding the arrangement of VNU-CLs, in a presentation sent to the Ministry of Home Affairs, the Department of Organization and Staffing also said that for localities, after the 2-level local government model went into stable operation from July 1, 2025, the organizational structure and tasks of VNU-CLs after arrangement have many changes; at the same time, localities are currently continuing to arrange VNU-CLs according to the direction in Resolution No. 105/NQ-CP by specific sectors, fields and by management level.
At the department level, arrange according to the direction of arranging the maximum number of CBs for each specific industry and field, ensuring the specific nature and promoting the implementation of autonomy;
At the commune level, arrange kindergartens, general schools, commune health stations and form multi-sectoral and multi-field public service providers, ensuring timely provision of basic and essential services in the area.
Accordingly, the implementation of financial autonomy for public non-business units of localities is continuing to be reviewed, built, and approved, in which the state ensures or supports basic and essential public service services for people, especially in remote, isolated, and difficult areas, ensuring social security, and promoting socialization of public service provision in places with conditions.
