Ministry of Home Affairs clarifies the approval of the number of people working in public non-business units

HƯƠNG NHA (báo lao động) 23/08/2026 10:12 (GMT+7)

The Ministry of Home Affairs said that Decree 106/2020/ND-CP is still in effect, and also provided information on the approval of the number of people working in public non-business units.

Ms. Minh Hong (name of the character changed) said that her unit is a 100% self-reliant public non-business unit. According to her, Decree 106/2020/ND-CP stipulates the process of approving the number of people working at the unit, but she believes that this Decree has expired.

Therefore, she proposed that the Ministry of Home Affairs clarify whether 100% self-governing public non-business units currently need to approve the number of employees or not; if so, what is the procedure for implementation and is it necessary to submit it to the Management Council or not.

Regarding Ms. Hong's proposal, the Ministry of Home Affairs has responded on the Electronic Information Portal.

Regarding the procedure for approving the number of employees in public service units, the Ministry of Home Affairs said: Currently, Decree No. 106/2020/ND-CP is still in effect (the Ministry of Home Affairs is submitting a Decree to replace the content of managing the number of employees in Decree No. 106/2020/ND-CP).

Based on the Law on Public Employees 2025 (effective from July 1, 2026) and Decree 299/2016/ND-CP, public non-business units do not stipulate a Management Council.

Management authority related to approving the number of employees in group 1 public non-business units will be adjusted in the Decree replacing Decree No. 106/2020/ND-CP.
