Instructions on paying professional preferential allowances for educational support personnel
Some localities face difficulties in paying professional preferential allowances for contract workers in public educational institutions.
Decree No. 182/2026/ND-CP officially takes effect from July 7, 2026, stipulating the professional preferential allowance regime for teachers, which is attracting special attention from teachers nationwide. According to the decree, teachers and official education support personnel are entitled to professional preferential allowances from 20% to 80%.
Currently, localities are in the process of implementing the decree, but encounter some obstacles in the process of paying allowances to teachers and contract staff in public educational institutions.
Some localities identify teachers and contract employees as eligible for professional preferential allowances, but other localities do not.
Reflecting to Lao Dong Newspaper, many nursing staff at schools in Hanoi said that they have not yet been paid allowances and received notices from principals that they must wait for instructions, because they do not know whether contract staff are eligible for payment or not.

In Lao Cai, there are also some problems in the implementation process. The Department of Education and Training of Lao Cai province has sent a document requesting guidance from the Ministry of Education and Training.
On August 4, the Department of Teachers and Educational Administrators (Ministry of Education and Training) issued a document responding to Lao Cai, and stated the grounds for enjoying professional preferential allowances for education support personnel.
The Department of Teachers and Educational Administrators cited the regulations:
Clause 1, Article 2 of Decree No. 182/2026/ND-CP dated May 22, 2026 of the Government stipulating the regime of professional preferential allowances for teachers, educational institution managers and educational support personnel working in public educational institutions stipulates: "Teachers, educational institution managers, educational support personnel working in public educational institutions under the national education system, including those who are in probation, apprenticeship or contract applying salaries according to the salary scale of civil servants".
Clause 1, Article 3 of Decree No. 182/2026/ND-CP stipulates: "The 20% preferential allowance level is applied to personnel supporting education work in preschool, general education, continuing education, vocational secondary schools, specialized schools, Friendship School 80, Friendship School T78, Viet Bac Highland High School, and centers supporting integrated education development".
Point a, Clause 1, Article 66b of Law No. 123/2025/QH15 amending and supplementing a number of articles of the Law on Education stipulates "Education support personnel in educational institutions include people working in professional and nghiệp vụ positions but not as teachers, supporting job positions and other job positions suitable to the organizational model of educational institutions as prescribed by competent authorities (hereinafter referred to as education support personnel)".
From the above grounds, the Department of Teachers and Educational Administrators emphasizes: Educational support personnel include:
Positions of professional and nghiệp vụ public employees but not teachers specified in the List of positions of professional and nghiệp vụ public employees in public non-business units (Appendix II issued together with Decree No. 232/2026/ND-CP dated June 26, 2026 of the Government regulating positions of public employees);
Positions of supporting civil servants specified in the List of positions of supporting civil servants in public non-business units (Appendix I issued together with Decree No. 232/2026/ND-CP);
Other job positions (except for the job position mentioned above) specified in the guiding documents on job positions, organizational and operating regulations, charters of educational institutions according to the regulations of competent authorities. Therefore, positions such as security guards, waiters, and cooks are identified as educational support personnel in educational institutions.
Based on the above regulations, the Department of Teachers and Educational Administrators affirms that the positions of security guards, servers, and cooks under labor contracts are being applied salaries according to the salary scale of public employees in preschool, general education, and continuing education institutions that are eligible for preferential allowances according to the profession specified in Clause 1, Article 3 of Decree No. 182/2026/ND-CP.
Currently, the team of teachers and contract employees wishes and proposes that the Ministry of Education and Training have a common guiding document for localities across the country to jointly implement, avoiding each locality having different understandings of the payment of professional preferential allowances for contract workers in public educational institutions.
