Proposal to subsidize from 6.5 million VND for preschool teachers who have quit their jobs and have not yet received benefits
The Ministry of Education and Training is seeking opinions on the draft Resolution regulating the one-time allowance regime for preschool teachers who have quit their jobs and have not yet enjoyed the regime.
The draft Resolution specifically stipulates the beneficiaries of allowances who are preschool teachers (including teachers, child caregivers, principals, vice principals, kindergarten principals, deputy kindergarten principals) and at the same time meet all 3 conditions.
First, preschool teachers have spent time working (including teaching, educating, nurturing, and caring for children) at nurseries, kindergartens, and beginners classes (hereinafter referred to as preschool education institutions) in communes, wards, neighborhoods, villages, hamlets, rural and forestry farms, production teams, cooperatives, factories, construction sites, farms, forestry farms, enterprises, agencies... in the period from 1960 to before January 1, 1995.
Second, preschool teachers who have retired from work but have not yet received a pension or have received a pension but the working period before January 1, 1995 is not included in the compulsory social insurance contribution period to receive a pension.
Third, preschool teachers who have not yet enjoyed the regime according to the provisions of Decree No. 14/2020/ND-CP dated January 24, 2020 of the Government stipulating the allowance regime for retired teachers who have not yet enjoyed seniority allowance in their pensions.
According to the draft Resolution, preschool teachers are subject to one-time allowances according to regulations. In which, 5 specific cases are clearly specified.
In case there are documents proving the number of years of service, the draft Resolution stipulates that if the working time is 3 years (36 months) or less at a preschool education institution, they are entitled to a subsidy level of 6,500,000 VND; if the working time is over 3 years, from the 4th year onwards, for each year (12 months) there is an additional 800,000 VND.
When calculating the time to implement the one-time allowance regime, if there are odd months, for every 1 month (30 days), each month will be added 67,000 VND. The remaining working days are not enough for 1 month and will not be enjoyed.
If the time spent working at preschool education institutions is interrupted, it is accumulated to calculate benefits; if there is both a period where the working time can be determined and a period where the working time cannot be determined, then the total time of the periods where the working time can be determined is calculated as the basis for enjoying benefits.
In case there are documents proving working time but no specific time of working participation is specified or there are no documents to prove that there has been working time at preschool education institutions, they are entitled to a one-time allowance level of 6,500,000 VND.
In case they have received a one-time allowance for the time working at preschool education institutions before January 1, 1995, they are entitled to a one-time allowance level of 6,500,000 VND.
In case of receiving a pension but the working time at preschool education institutions before January 1, 1995 is not included in the compulsory social insurance contribution period to receive a pension, they are entitled to a one-time allowance level of 6,500,000 VND.
In case a kindergarten teacher is eligible for the allowance but has passed away, the legal representative of the deceased relatives of the kindergarten teacher (including: wife, husband, biological father, biological mother, adoptive father, adoptive mother, biological child, adopted child) prepares a dossier to receive the allowance regime.
In case a kindergarten teacher loses civil act capacity, the guardian or guardian is naturally required to file a dossier to receive the allowance regime according to regulations.
The Ministry of Education and Training said that the Draft Resolution is built with the view that the regulations on dossiers, procedures, and procedures for resolving regimes for preschool teachers who have retired from work and have not yet enjoyed regimes are strictly ensured to avoid policy profiteering, but also do not cause difficulties, complications, or troubles for this team when implementing.
