Ministry of National Defense talks about proposal to subsidize demobilized soldiers without pensions

The Ministry of National Defense received a petition from voters in Thai Nguyen province transferred by the National Assembly's Committee for Petitions and Supervision regarding the transfer of voters' petitions sent after the First Session, 16th National Assembly.

Voters proposed to consider and study having a monthly allowance policy for subjects who are soldiers who participated in the resistance war and national defense for less than 15 years, have been demobilized, discharged from the army, and currently do not have pensions and other social allowances.

Regarding voters' petitions, the Ministry of National Defense has responded on the Electronic Information Portal.

Accordingly, there is currently no legal normative document related to the above-mentioned voters' recommendations that has been amended or supplemented.

In recent years, along with the socio-economic development of the country, our Party and State have paid attention to promulgating many regimes and preferential policies for people who participated in the resistance war, the war to protect the Fatherland and perform international duties.

The regulation of subjects and conditions to enjoy monthly allowances or one-time allowances according to the above Decision has been carefully studied by ministries and sectors, reported to the Party Committee of the Government, and submitted to the Politburo for policy approval, and the Prime Minister issued a Decision to implement the regime and policies; in accordance with the nature and characteristics of the actual time of participating in the resistance war, war to protect the Fatherland, performing international duties of each subject and the economic conditions of the country; and at the same time, generally balanced with the promulgated regimes and policies.

Therefore, voters' recommendation to consider issuing a monthly allowance regime for subjects who are soldiers who participated in the resistance war and national defense for less than 15 years, have been demobilized and discharged from the army, and currently do not have pensions and other social allowances is not consistent with the Conclusion of the Politburo and the Decisions of the Prime Minister; at the same time, it does not ensure fairness between subjects with actual service time in the Army under 15 years and over 15 years.

On the other hand, to ensure social security, on June 29, 2024, at the 7th Session, the 15th National Assembly passed the 2024 Law on Social Insurance, effective from July 1, 2025; accordingly, it has supplemented the subjects and conditions for enjoying social pension benefits guaranteed by the State budget; in which, cases belonging to poor households, near-poor households from 70 years old to under 75 years old and cases from 75 years old or older if they do not have a monthly pension or social insurance allowance are entitled to social pension allowances according to the Government's regulations.
